가상부동산 플랫폼과 지적제도 연계를 위한 탐색적 연구 (An Exploratory Study for Link between Virtual Real Estate Platform and Cadastral System)

초록

본 연구에서는 메타버스 기반의 가상부동산에 대한 개념적 정리와 선행연구 분석과 국내외 가상부동산 플랫폼 사례를 검토하고 시사점을 도출하고자 하였다. 국내외 가상부동산 플랫폼 사례를 검토한 결과, 도출된 시사점은 다음과 같다. 첫째, 가상부동산의 거래단위 및 면적이 상이하다는 점이다. 둘째, 최근 가상자산이 폭락한 예처럼 가상부동산도 디지털 자산으로서 높은 가격의 변동성이 위험요인으로 판단된다. 셋째, 최근 카카오 서비스장애 사례에서처럼 가상부동산의 경우에도 해당 서버가 화재 또는 다양한 이유로 정상적인 서비스 제공이 어렵다면 이용자의 부동산 거래 기록 및 자금 또한 함께 사라질 가능성이 높다. 마지막으로 가상부동산 플랫폼 간 차별성이 부족하다는 점이다. 이에 따라 국토를 효율적으로 개발하고 토지거래 과세에 대한 기초자료를 제공한다는 점에서 의의가 있는 지적제도와의 연계를 통해 현재 운영 중이거나 향후 생겨날 가상부동산 플랫폼에 대한 방향성 제시가 가능할 것으로 판단된다.
향후 다양한 이해당사자 간 공론화와 협의가 필요하겠지만 가상부동산과 지적제도 간 연계방향은 다음과 같다. 첫째 가상부동산의 법적 부동산으로 인정될 수 있는 입법화 과정이 필요하다. 둘째 지적제도 관점에서의 가이드라인이 필요하다. 셋째, 국가차원에서의 국내외 가상부동산 플랫폼 간 협정이 필요하다. 이는 가이드라인 수립과 맞물려서 광범위한 협의가 필요하며, 이를 통해 가상부동산의 불안정한 운영체계를 보완할 수 있다. 마지막으로 가칭 가상부동산정보시스템 구축을 통해 가상부동산 지적조사사업의 제도화가 필요하다.

영어초록

In this study, the conceptual arrangement of metaverse-based virtual real estate, analysis of previous studies, and cases of domestic and foreign virtual real estate platforms were reviewed, and implications were derived. Based on this, the direction was presented in terms of cadastral system and cadastral information for sustainable virtual real estate platform operation. As a result of examining domestic and foreign platform cases, the derived implications are as follows. At first, the transaction unit and area of ​​virtual real estate are different. Secondly, as in the recent case of virtual assets, virtual real estate is a digital asset, and high price volatility is considered a risk factor. Thirdly, in the case of virtual real estate as in the recent case of ‘Kakao’ internet company service failure, if the online server is unable to provide normal service due to fire or various reasons, it is highly likely that the user's real estate transaction records and funds will disappear together. Lastly, there is a lack of differentiation between virtual real estate platforms. Accordingly, it is judged that it will be possible to suggest directions for the virtual real estate platform that is currently in operation or will be created in the future by linking it with the cadastral system, which is meaningful in that it develops the national land efficiently and provides basic data on land transaction taxation.
Although public discussion and consultation among various stakeholders will be necessary in the future, the link between virtual real estate and the cadastral system is as follows. At first, our society needs a legislative process that can be recognized as legal real estate of virtual real estate. Second, guidelines from the point of view of the cadastral system are needed. Third, an agreement between domestic and foreign virtual real estate platforms at the national level is necessary. This requires extensive consultation in conjunction with the establishment of guidelines, and through this, the unstable operating system of virtual real estate can be supplemented. Lastly, it is necessary to institutionalize the virtual real estate cadastral survey project through the establishment of a tentative virtual real estate information system.
