초록

블록체인은 글로벌 P2P(peer-to-peer) 네트워크를 활용하여 제3의 신뢰기관을 거치지 않고 거래 당사자 간에 교환되는 가치의 무결성을 보장할 수 있는 장점 때문에 다양한 응용분야로 활용범위가 확대되고 있다. 블록체인은 특정 시간 동안 발생한 거래정보를 담아 블록을 생성하고, 모든 구성원에게 전송함으로써 블록 내 거래정보를 검증하고 이상이 없다면 기존 블록에 연결하는 방식으로 체인이 구성되는 구조이다. 이러한 블록체인 기술을 이용하면 서버가 아닌 네트워크에 정보가 저장된다. 새로운 정보가 네트워크상에 저장되므로 데이터의 위조나 변조가 어렵다. 따라서 블록체인은 기존의 중앙집중식이 가지는 문제점을 극복하고, 시스템의 무결성과 신뢰성을 바탕으로 하는 혁신기술이다.
블록체인 기술에 바탕한 스마트 계약은 블록체인의 특성상 스마트 계약 플랫폼에서 이뤄지는 계약으로 위조 및 변조가 불가능한 것으로 검증되었다. 자산이 특정인에게 양도되는 즉시 자산의 소유권 역시 즉시 검증이 가능하다. 동시에 부동산 소유자가 아파트 리모델링을 했다면 비용과 보수공사 내역을 확인하는 것도 가능하다. 이를 바탕으로 정부기관은 투명하게 세금을 책정 할 수가 있고, 부동산 매매 가격이 터무니없이 거래 시세보다 높거나 혹은 낮은 시세에 거래가 이뤄지면 정부가 즉시 이를 인식하고 그에 따른 세무상 조치를 할 수도 있다.
이미 많은 국가들이 국가 토지대장 구축과 건물 부동산 등기 관리에 블록체인 기술을 도입. 대부분 부동산 매매 및 임대 계약을 지원하여 소유권의 투명성 강화하고 있는 추세이다, 나아가 블록체인의 스마트 계약에 의해 부동산 거래를 하게 되면 각 블록에 거래 내역이 공적 분산장부 시스템에 공시되어 특정인의 개입에 의한 토지거래의 사기행위를 방지하는 것도 가능하다.
따라서 향후 우리나라에서도 부동산 거래 시장에서 활성화될 스마트계약과 블록체인 기술에 기반한 토지대장 및 등기부등본의 분산원장 시스템에 대하여 계약법적 근거 마련과 적절한 규제 방법을 모색할 때이다. 나아가 부동산 거래계에서도 부동산 가치의 투명성 확보로 부동산 금융업 비즈니스 확대 가능성을 구체적으로 검토할 때이다. 부동산 담보대출시 중보 평가의 정확성에 기한 비용을 절감할 수 있다. 이미 홍콩 HSBC 등 주요 은행은 모기지 평가에 블록체인 기술을 도입해 감정평가사와 여신심사자간 정보공유를 확대하고 있는 경향이다. 부동산 경쟁은 신뢰성 높은 데이터 자산 확보와 ’금융화‘ 모델에 의존하는 만큼 ’스마트 계약‘은 새로운 부동산 비즈니스 모델의 핵심 인프라가 될 전망이다. 블록체인을 기반으로 하는 새로운 스마트계약의 활성화를 위한 부동산시장 발전의 방안을 검토해야 할 때이다.
결국에는 블록체인의 기술적 이해와 스마트계약의 본질을 반영한 입법적 근거를 마련하기 위해서는 부동산거래 관련 스마트계약 시스템의 구축이 부동산 거래자의 편익과 보호를 위한 제도를 염두에 두고 현행 계약법 체계 내로 편입시키는 입법과정을 거쳐야 할 것이다. 그리고 부동산 거래질서의 건전한 문화 형성과 확립을 아울러 도모하는 계약법체계가 형성되는 입법적 문제해결이 선행 되어야 한다.

The block chain is being utilized in various application fields because it has the advantage of using a global peer-to-peer network to ensure the integrity of the value exchanged between trading partners without going through a third trust institution. A block chain is a structure in which a chain is formed by generating a block containing transaction information generated during a specific time, verifying the transaction information in a block by transmitting the block to all members, and connecting to the existing block if there is no abnormality. Using this block chain technology, information is stored on the network rather than on the server. Since new information is stored on the network, it is difficult to counterfeit or tamper with the data. Therefore, the block chain overcomes the problems of the existing centralized system and is an innovation technology based on the integrity and reliability of the system.
The smart contract based on the block chain technology is proved to be impossible to be falsified and altered by the contract that is made on the smart contract platform due to the characteristics of the block chain. As soon as the asset is transferred to a specific person, the ownership of the asset can be verified immediately. At the same time, if the property owner has remodeled the apartment, it is possible to check the cost and maintenance details. This allows the government to set taxes transparently, and if the real estate sale price is ridiculously higher or lower than the quoted price, the government can immediately recognize it and take tax action accordingly.
Many countries have already introduced block-chain technology to the national land registry and building property registration management. In most cases, real estate transactions are carried out by smart contracts of the block chain. Transaction details are disclosed to the publicly distributed book system, It is also possible to prevent fraudulent transactions.
Therefore, it is time for Korea to find legal basis of contract and appropriate regulation method for the distributed ledger system of land register and registered register based on smart contract and block chain technology to be activated in real estate transaction market in Korea. In addition, it is time to examine the possibility of expanding the real estate finance business by securing transparency of the value of real estate transactions. It is possible to reduce the cost due to the accuracy of the interim evaluation when real estate mortgage is loaned. Major banks, including Hong Kong HSBC, have already introduced block-chain technology for mortgage evaluation, and are increasingly sharing information between appraisers and credit judges. As competition for real estate relies on reliable data assets and a ‘financialization’ model, ‘smart contract’ is expected to become a core infrastructure of the new real estate business model. It is time to consider ways to develop the real estate market for the activation of new smart contracts based on block chains.
In the end, in order to establish a legitimate ground that reflects the technical understanding of the block chain and the nature of the smart contract, it is necessary to establish a smart contract system for the real estate transaction, incorporating the system for the benefit and protection of real estate traders into the existing contract law system. You will have to go through the process. It should be preceded by the solution of the legislative problem that forms the contract law system which will form the sound culture formation and establishment of the real estate transaction order.
