통일 후 북한지역 부동산 소유권 처리 방안모색 (A Study on the Real Estate Ownership Process in North Korea after Unification)

초록

본 연구에서는 통일한국에서 북한지역 부동산 소유권 문제 해결의 실마리 마련과 통일 부동산법제의 구축을 위한 시사점을 얻고자 한다.
통일한국에서의 통일 부동산법제의 구축 내지 북한지역 토지와 건물 소유권 처리 문제는 남북한의 경제통합, 통일비용의 최소화, 인구이동의 최소화, 경제성장, 복지향상 등과 직결되는 문제이다. 또한 통일 추진과정에서 북한당국과 북한 인민들의 동의와 협조를 이끌어내기 위한 측면에서도 통일후 북한 지역 토지소유권 및 건물이용권 문제에 대한 처리방침과 정책의 제시는 중요한 의미를 가진다고 본다.
남북한 통일의 방식과 통일의 형태는 남북한의 합의와 결단에 의하여 결정되겠지만, 통합의 방식과 형태와는 관계없이, 통일한국에서 토지제도 수립시 고려할 사항으로는 시장경제적 토지소유제도의 확립, 북한주민에 대한 정서적・경제적 배려, 국토의 합리적 이용과 보호를 전제한 북한 토지의 효율적 이용, 통일비용을 고려한 토지정책의 추진, 몰수토지에 대한 처리방안 마련 등일 것이다.
특히 북한지역 국유토지와 부동산이용권의 사유화를 어떻게 진행할 것인가가 통일방식의 선택과 관련하여 가장 주요한 문제 중의 하나가 될 것이다. 자유민주적 기본질서와 자본주의 시장경제체제에 기반한 통일이 이루어지는 경우, 북한 지역 토지소유권 문제와 관련하여 가장 큰 쟁점이 되는 문제는 북한 정권에 의하여 몰수 내지 국유화된 부동산의 처리, 북한지역 토지의 사유화방안, 북한지역 주민들의 부동산이용권과 관련된 기득권 보호 문제 등일 것이다. 독일, 헝가리, 러시아, 중국의 경우를 살펴봄으로써 우리에게 적합한 방식의 선택에 대하여 시사점을 얻는 것은 이 시점에서 아주 중요하다.

영어초록

This study aims to find out the clues to the problem of real estate ownership in North Korea and to establish the unified real estate law in the unified Korea.
The issue of establishing a unified real estate law in unified Korea or handling land and building ownership in North Korea is directly related to economic integration between the two Koreas, minimizing unification costs, minimizing population movement, economic growth, and welfare improvement. In addition, in order to draw the consent and cooperation of the North Korean authorities and the North Korean people in the process of unification, it is important to present the policy and policy on the land ownership and building use rights in North Korea after unification.
The methods and forms of unification between the two Koreas will be determined by the agreement and decision of the two Koreas, but regardless of the method and form of integration, the matters to be considered in establishing the land system in the unified Korea include the establishment of a market economic land ownership system, emotional and economic consideration for North Koreans, efficient use of North Korean land based on rational use and protection of the country, promotion of land policy considering the cost of unification, and preparation of treatment plans for confiscated land.
In particular, how to proceed with the privatization of the state-owned land and real estate rights in North Korea will be one of the main issues related to the selection of unification methods. If the unification based on the liberal democratic basic order and capitalist market economy system is achieved, the biggest issue in relation to the land ownership issue in North Korea is the confiscation or the processing of nationalized real estate by the North Korean regime, the privatization of land in North Korea, and the protection of vested rights related to the real estate rights of the residents in North Korea. It is very important at this point to get implications for the choice of the right way for us by looking at the cases of Germany, Hungary, Russia and China.
