초록

이 연구는 블록체인이라는 새롭게 등장한 기술을 통해 지역 부동산 관리의 새로운 대안을 모색하고자 하는 탐색적 연구이다. 저자는 지역 부동산의 공유(共有)를 효과적인 유휴 부동산의 지역적 관리 방안으로 주장하며, 이를 활성화하기 위한 방안으로 블록체인의 활용을 제안한다. 이를 위해 먼저 지역 부동산 공유의 개념과 효과, 활성화를 위한 전제조건에 대해 이론적으로 살펴보며, 블록체인 기술의 등장 배경과 개념, 장점에 대해서도 기존 문헌과 정보들을 바탕으로 요약하여 제시한다. 이를 바탕으로 지역 부동산 공유의 필요성과 블록체인의 등장 배경이 유사하며, 실제로 지역 부동산 공유를 위한 전제조건을 블록체인 기술이 대부분 충족시킬 수 있다는 점을 논증한다. 이어서 블록체인을 활용한 부동산 조각투자의 개념과 실제 한국에서 운영되고 있는 사례와 정책 동향을 살펴보고, DAO를 통해 실물 부동산을 소유하도록 법제화한 미국 와이오밍주의 사례를 통해 이 연구에서 제시하는 방안의 실현 가능성을 실증적으로 보여주고자 한다. 최종적으로 블록체인을 활용한 지역 부동산 공유 방안을 DAO를 활용하는 분산형과 ‘지역 부동산 관리조직’을 통한 통합형으로 나누어 제시하고 장단점을 비교하여 향후 도입 논의의 기반을 제시한다.

영어초록

This study is an exploratory research aimed at identifying novel alternatives for local land and housing management through the application of blockchain, an emergent technology. It proposes the concept of shared ownership of local land and housing as an effective method for the regional management of vacant properties and suggests the utilization of blockchain technology as a facilitating mechanism. To this end, the study commences with a theoretical examination of the concept and effects of shared ownership of local land and housing, as well as the prerequisites for its implementation. Additionally, it synthesizes the background, conceptual framework, and advantages of blockchain technology based on a comprehensive review of extant literature and relevant information. Building upon this foundation, the study postulates that the imperatives driving shared ownership of local land and housing and the contextual factors leading to the emergence of blockchain technology are analogous, and that blockchain technology possesses the capacity to fulfill the majority of preconditions necessary for effectuating shared ownership of local land and housing. Subsequently, the study delves into the concept of tokenized fractional investment in real estate leveraging blockchain technology, analyzing current cases and policy trends in Korea. It aims to empirically substantiate the feasibility of the proposed methodology through an examination of the case of Wyoming, USA, which has enacted legislation permitting the ownership of physical land and housing through Decentralized Autonomous Organizations (DAOs). Through this analytical progression, the study culminates in the presentation of methodologies for implementing shared ownership of local land and housing via blockchain, categorized into decentralized and integrated typologies. It conducts a comparative analysis of their respective advantages and disadvantages, thereby establishing a foundational framework for future implementation.
