부동산임대차 계약해지 관련 법제의 개선방안 (Improvement Plan of Legislation Related to Termination of Real Estate Lease Contract)

2024. 1. 11. 대법원은 임차인이 주택임대차보호법 제6조의3 제1항에 따라 임대차계약의 갱신을 요구하고 계약갱신의 효력이 발생한 경우에 임차인이 “언제든지” 임대인에게 계약해지를 통지할 수 있다고 판결하였다. 이 연구에서는 위의 경우에 단서를 추가하여 임대인과 임차인이 상호간에 합의하여 약정한 경우에는 상호간에 합의한 그 약정내용에 따라 통지하여 계약해지할 수 있도록 법령을 보완할 것을 제안하였다.
그리고, 부동산임대차와 관련하여 발생하는 여러 가지 분쟁유형중 부동산임대차 계약해지 관련 분쟁에대하여 이론과 현행법제 및 판례를 살펴보고 그 문제점을 분석하여 합리적인 개선방안을 모색하였다.
민법상 기간의 약정없는 임대차의 해지통고에서 임차인의 해지통고효력 발생의 기한과 차임연체시 해지요건 기간에 대한 개선방안을 제안하였고, 특별법인 주택임대차보호법 및 상가건물임대차보호법상 계약의 묵시적 갱신요건인 의사표시의 기한 및 묵시적 갱신규정을 적용하지 않는 차임액연체의 요건에 대하여 연구하였다. 그리고, 계약갱신요구 등에서 임대인이 거절할 수 있는 사유와 갱신되는 임대차의 존속기간에 대한 형평성 실현방안을 탐구하였다.
부동산임대차의 계약해지에서 임대인과 임차인 상호간에 합리적이고 법익의 균형성이 있는 권리행사와 사적자치의 원칙을 실현하고, 계약해지 의사표시에 의한 법률행위와 법률효과의 요건을 명확히 규정하며, 부동산임대차관계에서 일방적으로 해지를 통지하는 경우의 기한 또는 실무적으로 촉박한 해지효력 요건충족기한을 합리적인 방법으로 변경하는 개선방안에 대하여 계속적으로 연구할 필요가 있다.

2024. 1. 11. The Supreme Court held that if the tenant requests the renewal of the lease under sub-section (1) of section 6(3) of the Housing Lease Protection Act, and the renewal of the contract takes effect, the lessee may give notice to the landlord of the termination of the contract “at any time”. In this study, it was proposed to add a proviso to the above case and amend the statute so that if the landlord and tenant have entered into a mutually agreed-upon agreement, the landlord and tenant can terminate the contract with notice in accordance with the mutually agreed agreement.
In addition, among the various types of disputes that arise in relation to real estate leases, we examined the theories, current legal systems, and judicial precedents for disputes related to the termination of real estate leases, analyzed the problems, and sought reasonable improvement measures.
In the case of a notice of termination of a lease without a term under the Civil Act, we proposed an improvement plan for the deadline for the tenant’s notice of termination to take effect and the period of termination requirement in case of late payment of the chime, and studied the requirements for the delay of the lease that does not apply the implied renewal requirements of the contract under the Housing Lease Protection Act and the Commercial Building Lease Protection Act, which are special laws. In addition, we explored the reasons why a landlord can refuse a request for contract renewal and how to achieve equity in the duration of the lease to be renewed.
It is necessary to realize the principle of exercise of rights and private autonomy that is reasonable and balanced between the landlord and the tenant in the termination of the contract of real estate lease, to clearly define the requirements for legal acts and legal effects by expressing the intention to terminate the contract, and to continuously study the improvement measures to change the time limit in the case of unilateral notice of termination in the real estate lease relationship or the deadline for meeting the requirements for the effect of termination in a reasonable way.
