담보지상권 실무와 부동산 경매 (Practical Necessity of Collateral Superficies Right and Real-Estate Auctions)

초록

건물이 존재하지 않는 토지를 담보로 금융기관 등이 담보대출을 해줄 때 저당권과 함께 지상권까지 설정하는 관행이 오랫동안 있어 오고 있으며 이러한 지상권을 담보지상권이라고 한다. 이 담보지상권과 관련하여 근래 여러 개의 판례가 선고되었고 많은 연구논문이 발표되고 있다. 그런데 대부분 연구의 중점은 이론적으로 가치권인 (근)저당권과 용익물권인 지상권의 본질 등을 중심으로 이루어지고 있다. 그러나 이 담보지상권 문제는 이론적인 문제가 아닌 실무상의 필요성으로 인해 오래전부터 발생되어 이용되어오고 있고 부동산 경매 등 실무문제와도 밀접한 관련이 있는 문제이므로 이 부분에 대한 중점적인 검토와 연구를 하여 보았다. 그리고 담보지상권등기가 금융기관 등에서 악의적으로 소유자의 토지이용권을 박탈하기 위하여 이용된 것이 아니라, 근본적으로는 우리 민법은 건물을 토지와 독립된 부동산으로 하면서 부동산 경매에서는 등기가 가능한 건물만 경매의 대상으로 하다 보니 경매실무상 무허가 건물 등은 종전 건물에의 부합물이거나 종물이 아닌 이상 경매를 진행할 방법이 없어서 발생하는 문제라고 할 수 있다. 그렇다고 이들 경매할 수 없는 물건 등을 그대로 경매하지 못하게 남겨둔다고 해서 그것이 소유자에게 도움이 되는 것도 아니고 오히려 재산권 행사도 못하고 철거하게 되며 그 비용까지 부담하게 될 수도 있다. 그러므로 이 문제는 가치권인 (근)저당권과 용익권인 지상권에 대한 연구만 가지고는 근본적인 해결이 어려울 것이므로 보이며 보다 근본적으로는 이러한 물건에 대하여도 일괄매각 등이 가능하게 하는 부분에 대하여도 연구 및 제도 개선이 있어야 할 것이다.

영어초록

Registration of the superficies right along with mortgage has long been customary in Korea when financial institutions issue a collateral loan secured on undeveloped land without the presence of any buildings. Such type of superficies is referred to as the collateral superficies right. Recently several precedents have been declared and numerous researches have been conducted with regards to collateral superficies. Prior research, however, tends to focus on theoretical approaches to (floating sum) mortgage that are value rights and superficies which are,in essence,real rights for use. The problem of the collateral superficies right, however, is not a theoretical one but a practical one, in that superficies are used out of practical necessity and the collateral superficies right is closely related to practical issues such as real-estate auctions and etc. Therefore, this study focuses on analysis and research on practical problems regarding the collateral superficies right.
It is a common misbelief that financial institutions take advantage of the registration system of thecollateral superficies right as a deliberate means to deprive owners of their real rights for use of land. Rather, such registration system is used to respond to the status quo where there is no alternative to auction buildings constructed without permission unless they are attached or accessory to the existent building, since the Civil Act of Korea classifies buildings as real-estates that are independent to the land, but only applies real-estate auctions to buildings that are eligible to register. It cannot be denied that the collateral superficies right has played a significant role in the real-estate collateral loan market of undeveloped lands. Furthermore, current research on(floating sum) mortgagethat are value rights and superficies which are real rights for use is not enough to tackle the aforementioned problems that arise in practice. In essence, further study and institutional improvement are necessary regarding the possibility of en bloc sale of properties that are ineligible for auction,such as buildings constructed without permission, and etc.
