탐정사제도의 법제화에 관한 소고 (Appeal on the legalization of the detective agency system)

초록

최근 사회변화에 따른 각종 범죄 증가와 사회적 부작용 등으로부터 개인의 안전욕구와 재산 및 권익보호에 대한 국민의 치안수요에 실질적으로 그 역할을 다하고 새로운 직업 및 산업분야로 정착할 수 있도록 탐정사제도의 입법화와 관련 법률의 제 정비가 신속히 이루어져야 한다.
우리나라의 탐정사업은 그동안 정치, 역사, 사회적으로 변화의 과정을 거쳐 오면서 아직 불법이라는 오류를 벗지 못함에 따라 탐정사활동에 대한 수요공급 체제가 왜곡되어 불법적․음성적인 심부름센터 등의 폐해증대, 국가 사법기관의 업무부담 증가, 치안서비스의 미흡, 탐정사업의 국제경쟁력 저하 및 편법적 정보획득, 국민의 국가기관에 대한 불신 및 준법의식의 해이 등의 부정적 악순환들이 계속적으로 유발되어 왔으며, 이와 관련하여 탐정사제도 도입의 필요성이 꾸준히 제기되었다.. 국회제출 탐정사법률(안)을 살펴보면 ‘1999년도에 국회에서 ‘공인탐정에 대한 법률(안)’ 입법이 처음 시도 되었으며, 25년이 지난 지금도 탐정사법제와 관련한 법률안 15여건은 철회되거나 임기만료로 폐기 되었다. 국가 공권력에 의한 법집행에 대응할 수 없는 공권력 한계극복과 미래일자리창출을 통한 국민의 권익을 보호하기 위해 국회에서 여러 번 입법안이 시도되었으나 입법화되지 못하였다. 개인정보와 사생활 침해 등 부정적인 견해와 관리감독기관 설정의 대립, 기존 타 법률과의 충돌 문제 등 현재까지 탐정사 법률안 입법화에 어려움을 겪고 있는 실정이다.
우리나라는 탐정사제도가 없는 OECD 가입국가 중 유일한 국가로서 모든 범죄발생 사건을 수사기관에서 처리하고 있다. 개인간 분쟁이나 복잡한 사건 등 다수 발생되는 현대의 시대적 흐름 속에서 공권력에 의존하지 않고 합법적인 절차에 따라 원만히 해결할 수 있는 탐정사제도가 입법되어 시행되면 사회적 사인간 분쟁에 소모되는 시간 및 비용을 줄일 수 있고, 더 나아가 삶의 질을 높이고 시민의 만족도가 높을 것으로 기대된다. 현재 탐정사법률의 부재로 심부름센터, 흥신소 등 유사탐정사업체가 난립하여 국가 관리감독 밖으로 방치되고 있어 개인정보와 사생활 침해 등 인권침해가 일어날 수 있는 문제점이 상존하고 있다.
. 현재 우리나라 탐정사제도의 도입은 언제라는 관점보다는 어떻게 도입·시행하여야 하는가의 과제를 안고 있으며, 이를 위한 연구는 계속되어야 할 것이다. 국가의 철저한 관리와 규제 하에 일정한 자격과 경력을 갖춘 사람에게 자격증을 부여하여 탐정사 활동 중 각종 인권침해 등의 부작용 발생을 사전에 방지하고, 불법행위 예방과 근절은 물론 합법적인 탐정사 업무활동을 통한 국민의 개인적 치안서비스 수요욕구 충족, 사법제도 보완, 국제경쟁력 제고 등의 긍정적인 측면을 장려하고 발전적인 방향으로 정착시킨다면 탐정사제도의 도입은 실질적인 복지국가 발전을 위해서도 그 의미는 매우 크다고 볼 수 있다.

영어초록

The legislation of the detective agency system and related laws should be made quickly so that it can actually fulfill its role in individual safety needs and public security demands for property and rights protection from various crimes and social side effects caused by recent social changes and settle into new occupations and industrial fields.
As Korea's detective business has not yet cleared itself of the error that it is illegal as it has gone through the process of political, historical, and social changes, the supply and demand system for detective activities has been distorted, increasing the burden on state judicial institutions, increasing the burden on state judicial institutions, insufficient security services, reducing international competitiveness of detective projects and acquiring expedient information, and the need to introduce a detective system has been steadily raised. Looking at the National Assembly's submitted detective judicial law (draft), the National Assembly first attempted to legislate the "law (proposal) on certified detectives" in 1999, and 25 years later, 15 bills related to the detective judicial system have been withdrawn or abolished at the end of their term. Legislation has been attempted several times at the National Assembly to protect the rights and interests of the people through the overcoming of the limits of public power that cannot respond to law enforcement by the state's public authority and the creation of future jobs, but it has not been legislated. It has been difficult to legislate the detective law until now, including the confrontation between negative views such as personal information and privacy infringement and the establishment of a management and supervisory agency, and conflict with other existing laws.
Korea is the only OECD member country that does not have a detective system, and all crime cases are handled by investigative agencies. In the modern trend of the times, in which a number of individual disputes and complex cases occur, if a detective system is legislated and implemented that can be smoothly resolved according to legal procedures without relying on public power, it is expected to reduce the time and cost spent on disputes between social persons, further improve the quality of life, and increase citizens' satisfaction. Currently, due to the absence of the detective justice law, similar detective businesses such as errand centers and entertainment offices are scattered and neglected outside the state supervision, and there are problems that can cause human rights violations such as personal information and privacy violations.
. Currently, the introduction of the detective agency system in Korea has a task of how to introduce and implement it rather than when, and research to this end should continue. Under the strict management and regulation of the state, certification is granted to persons with certain qualifications and experience to prevent the occurrence of side effects such as human rights violations during detective activities, prevent and eradicate illegal activities, and encourage and develop positive aspects such as meeting the people's personal demand for security services, supplementing the judicial system, and enhancing international competitiveness.
