변호사 징계제도의 개선에 관한 소고-영국의 변호사징계제도와의 비교를 중심으로 (A Study on the Improvement of the Disciplinary System of the Attorney; with a focus on the compartive analysis with the U.K. Disciplinary System)

초록

변호사의 직무수행은 그 특성상 고도의 공공성이 요청되고, 동시에 다른 직업에 비추어 많은 특권이 부여되는 만큼 고도의 직무 윤리가 요구된다. 우리의 변호사법과 대한변협의 변호사 징계규칙은 변호사의 징계제도의 근거가 되는 규범으로서, 징계 사유로서 변호사의 직무와 관련하여 2회 이상 금고 이상의 형을 선고받아 그 형이 확정된 경우, 변호사법 위반의 경우, 소속 지방변호사회나 대한변협의 회칙을 위반한 경우, 직무의 내외를 막론하고 변호사로서의 품위를 손상하는 행위를 한 경우 등을 규정하고 있다. 그러나 이와 같은 징계사유에 대한 규정은 지나치게 단순하며, 구체적인 위반행위에 대한 적절한 징계수위를 결정함에 있어서 필요한 요건과 기준을 제시하지 않고 있다. 이에 비하여 영국의 변호사 징계제도는 사무변호사와 법정변호사를 각기 규율하는 규제기구가 자율적으로 제정한 규칙에 의해 징계의 사유와 적절한 징계의 유형 및 상한과 하한, 가중요소와 감경요소를 상세하게 기술하고 있어 구체적인 지침을 제시한다는 점에서 우리 변호사 징계제도의 개선에 있어 참고할만하다. 이에 본 논문에서는 영국의 변호사제도 및 영국 변호사의 징계제도의 개관에 대해 살피고 사무변호사와 법정변호사의 징계절차 및 징계사유 및 기준에 관한 규칙에 대해 분석하고 우리 징계제도에의 시사점을 찾아 보도록 한다.

영어초록

The practice of the attorney calls for the highest professional responsibility since the profession calls for the utmost publicness, thus enjoys many priviliges not granted to other professions. The regulation of disciplinary system in Korea is based on the Korean Attorney-at-law Act and the Attorney Disciplinary Rules of Korean Bar Association, which concurrently provide the grounds for sanctions such as cases where an attorney-at-law is sentenced to imprisonment without labor or greater punishment on not less than two occasions in connection with the duties of an attorney-at-law and the execution of such sentence is made definite, where he or she violates the Korean Attorney-at-law Act, the regulations of a local bar association or of the Korean Bar Association, or where he or she engages in conduct which damages his/her dignity as an attorney-at-law. However the provisions regarding the grounds for sanctions are simple and abstract and do not present the pertinent requirements and standards in deciding the level of sanctions for the professional misconduct. Compared to the Korean system, the disciplinary system in U.K. presents a good example in elaborating the grounds for sanctions in detail and enumerating the circumstances, the available types and range of sanctions, the aggravating or mitigating factors, etc., by the rules and guidance of the respective regulating bodies of solictors and barristers. In this regard, this paper will firstly overview of the outlines of the disciplinary system of U.K., analyze the procedures, grounds and the guidance thereof provided by the rules and guidances of Bar Standards Board and Solicitors Regulation Authority, and finally examine their implications to the Korean legislation.
