초록

한국에 근대경찰이 도입된 후, 경찰학이 학문적 위상을 가진 역사는 그리 길지 않다. 경찰학과 인접 학문분야와의 경계성, 체계화, 정체성 확립 수준은 그리 만족스럽지 않다. 학자들의 학문적 배경에 따라서 경찰제도 및 경찰학을 이해하는 관점에도 많은 차이가 있다. 근대 이후 한국 경찰제도 발전과정은 크게두 가지 시대로 나누어 볼 수 있다. 첫 번째는 근대와 前근대를 구분할 수 있었던 1894년 갑오개혁기에 도입된 프랑스 및 독일을 중심으로 한 대륙법계의「行政法學的 警察槪念」과 전통의 영향을 강하게 받았던 때이다. 두 번째는 8.15해방이후 美軍政期를 거치면서 관리적, 생활질서를 기반으로 한「警察行政學的 警察槪念」을 이념으로 한 영미식 경찰제도의 영향을 들 수 있다.
연구자는 평소 경찰학의 정체성을 확인하고자 고민해왔는데, 두 가지 경찰전통이 혼재된 한국적 특수상황을 이해하게 되었다. 경찰학에 대한 다양한 접근방법들 가운데, 역사적 접근방법에 터 잡아 근대경찰 형성기에 대륙법계 경찰제도와 전통이 일본을 통하여 도입된 과정을 우선적으로 해명해 보고자 하였다. 다양한 사료들을 통하여, 한국의 경찰학을 이해하는데 도움이 될 대륙법계 경찰(행정)법학적 전통을 규명하였다. 구한말 근대경찰 형성기를 중심으로 한 警察史 연구가 경찰학의 면모를 확인하고 정체성을 확립하는데 도움이 되었으면 한다.

영어초록

Compared to the development of modern policing in Korea, the history of Police Science in Korea is relatively short.“Police Administration” was first adopted as an educational course at Dongguk University in the early 1960s. Now, expansion of Police Science is rapidly progressing in Korea as interest in scholarly and practical research in Police Science spreads throughout the country. However, progress is much less satisfactory in systemizing research and establishing the academic identity of Police Science, as well as determining the boundaries with other similar fields of research. Perspectives on Police Science and the criminal justice system in general differ significantly among researchers of different academic backgrounds.
Development of modern policing in Korea can be generally divided into two eras. First was in 1894 during the Gabo(甲午) reforms, when Korea adopted from Japan the concept of policing based on administrative law from the continental legal tradition of France and Germany. During this era, the traditional system of law enforcement in Korea also had been strongly influenced. Another era is after the liberation from Japanese colonial occupation and temporary US military administration after World War Ⅱ, when the concept of policing based on police administration was adopted. This era is marked by strong influence from the Anglo-American criminal justice system, particularly in terms of administration and maintaining public order.
This article attempts to verify the identity of Police Science convoluted by two distinctive influences from the continental tradition and the Anglo-American tradition. Basically, this article takes the historical approach of analysis on police science to clarify the process of how the continental tradition of policing was introduced to Korea from Japan during the era of Gabo reforms. Through analyzing diverse historical data,a clear definition of the continental tradition of police laws is given to help understand Police Science in Korea. By focusing on the introductory stage of modern policing during the pre-colonial period of Korean history,this research attempts to give a clearer picture of the state and identity of Police Science in Korea.
