초록

제3공화국, 박정희 정부의 탄생은 1963년 12월 17일 대한민국 헌법개정사상 제5차 개헌헌법의 시행과 함께 시작되었다. 제3공화국 헌법은 ‘권력분립의 원칙(Gewaltetnteilungsprinzip)’에 따라, 일단은 국가권력을 분산하고 있었으나, 미국식인 완전한 권력분립적 대통령제가 아니고, 대통령에게 행정권뿐만 아니라 국가긴급권 등을 보장하여 행정부(집행부) 우월적인 경향을 띠게 되었다. 정당국가적 성격, 즉 정당우월적인 경향이 나타났고, 대통령은 여당의 대표가 됨으로써, 대통령이 국가원수 · 행정부의 수반일 뿐만 아니라 국회여당의 지배자로군림하였다. 이러한 ‘권력융화주의(權力融和主義)’는 (결과적으로) 대통령이 국회를 그가 원하는대로 지배하는 강력한 권한을 가지게 되었다. 따라서 형식적 ‘권력분립(Gewaltenteilung)’은 이루어 졌으나, 권력분립의 원칙의 핵심요소인 실질적 ‘권력균형(Gewaltenbalancierung)’은 제한되었다. 권력균형이 이루어져야 진정한 권력분립이 이루어지는 것을 말할 나위없다. 제6차개헌의 주요 내용은 대통령의 임기를 연장하기 위한 3선개헌이다. 국회의원정수의 상한을 250명으로 확대하였다. 국회의원은 법률이 정하는 공사의 직을 겸할 수 없다고 하여,국회의원이 겸직할 수 없는 직(職)을 법률로 정하도록 하였다. 대통령의 계속재임은 3기에 한한다고 하여 장기집권을 길을 열어놓았다.

영어초록

The birth of the Third Republic of Korea was begun from being enforcedthe 5th amended constitution since the constitutional reform in the Republicof Korea on December 17, 1963. This constitutional law was dispersingnational power, above all, according to ‘the separation of the powers(Gewaltetnteilungsprinzip),’ but guaranteed not only the administrativeauthority but also the national emergency right of the President, not theperfect power-division presidential system that is American style, therebyhaving come to have superior tendency over the administration(executivebranch). The Parteienstaat-based nature, namely, the dominant political partiestendency was shown. The President becomes the representative of the rulingparty, thereby having dominated as a ruler of the ruling party in the nationalassembly as well as the Chief of the State and the head of the administration.
‘Power harmony principle(權力融和主義)’ in this way resulted in allowing thePresident to have the powerful authority of substantially dominating thenational assembly as her or she wants. Accordingly, the formal‘Gewaltenteilung’ was achieved. Yet, the substantial ‘Gewaltenbalancierung,’which is the key element of the principle for the separation of power, wasrestricted. The major content of the 6th constitutional amendment is the3-time constitutional reform for extending the President's tenure. The maximum for the fixed number of National Assembly members was expandedto 250 people(Article 36, Clause 2). A National Assembly member wasmentioned to be unable to have both public and private posts of beingprescribed by the law. Hence, the position(職) that a lawmaker cannot holdmore than one office was set to be established by law(Legal Reservation ofFundamental Rights Restriction)(Article 39). The continuing reappointment ofthe President was stated to be the third stage, thereby having opened a wayof seizing long-term power.
