해외주식투자전용펀드 비과세제도가 펀드 투자에 미치는 영향 (A Study on the Effect of Tax Exemption on the Capital Gain from Fund on Investment in Fund)

초록

펀드는 우리나라 자본시장에 대표적인 금융투자자산 중 하나로 자리매김하였고, 이는 펀드 설정 잔액의 규모와 타 금융상품간의 비교를 통해서도 확인할 수 있다. 그러나 양적 성장에도 불구하고 우리나라의 펀드세제는 비교적 안정적이지 못하였고, 직접투자자에 비해 불리한 세제 적용을 하는 경우가 많았다. 대표적으로 집합투자기구부터의 이익을 집합투자재산의 성격에도 불구하고 일괄적으로 배당소득으로 분류하고, 직접투자시에 과세 제외 등의 혜택이 있던 자산들이 집합투자기구를 통해서 투자를 하는 경우에는 그 적용을 받지 못하는 문제점이 있었다.
이러한 까닭에 세제 변화가 펀드 투자에 미치는 영향이 선행 연구에서 발견되었고, 본 연구에서 제도적 배경으로 삼은 조세특례제한법 제91조의 17 상의 해외주식투자전용집합투자기구 비과세 제도에서도 부분적으로 확인이 되었다. 본 연구에서 펀드 미시 수준의 데이터를 활용하여 분석을 한 결과 해당 제도의 도입으로 해외주식형 펀드의 현금순유입이 국내주식형 펀드에 비해 유의하게 증가한 것으로 나타났고, 선행 연구에 활용되지 않았던 환율 및 벤치마크 수익률을 통제 변수로 사용하여도 동일한 결과가 나타났다. 특히 제도 시행 시점 전후로 조세혜택을 받을 가능성이 높은 해외주식형 펀드 투자에 순유입현금흐름이 증가하였던 반면 세제혜택을 받을 수 없는 국내주식형 펀드의 순유입현금흐름은 오히려 감소되어, 조세유인으로 인해 펀드투자자가 국내주식형 펀드를 환매하고, 해외주식형 펀드를 투자하는 현상이 있었을 것으로 추정된다.
이러한 결과는 집합투자재산의 성격을 고려치 아니하고 과세하는 현행 소득세 체계가 펀드투자자에게는 투자의 저해 요소인 것으로 추론할 수 있다. 본 연구는 펀드의 미시자료를 활용하여 최근에 한시적으로 적용된 해외주식투자전용펀드 비과세 세제가 펀드 투자에 어떠한 영향을 미쳤는지를 실증적으로 분석하였다는 점에서 의의가 있다.

영어초록

Funds have become one of the leading financial investment assets in the Korean capital market, and this can be confirmed by comparing the size of the fund balance and other financial products. However, in spite of quantitative growth, Korea 's fund tax system was relatively unstable, and detergent application was often disadvantageous compared to direct investors. For example, if the characteristics of the profits from the collective investment organization are classified as dividend income in spite of the nature of the collective investment property, and the assets that had benefits such as tax exemption at the time of direct investment are invested through the collective investment organization There was a criticism that it was not applicable and it became a problem of tax equality.
For this reason, the impact of taxation on the investment of funds has been found empirically in several previous researches. In the present study, the tax exemption system for foreign investment invested in overseas stocks under Article 91 (1) . As a result of analysis using fund micro level data, the net cash inflow of overseas equity funds increased significantly compared to domestic equity funds due to the introduction of the system, and the exchange rate and benchmark return rate, which were not utilized in previous studies, The same results were obtained. In particular, while net inflows to foreign equity fund investments, which are highly likely to receive tax benefits before and after the enforcement of the system, increased, net inflows of domestic equity funds, which are not eligible for the tax benefits of the tax-free system, It is estimated that there was a tendency to repurchase domestic equity-type funds and invest in overseas equity-type funds.
It is possible to deduce that the present income tax system that classifies the investment income as the dividend income rather than the nature of the investment property to be invested is an impediment to the current investment. This study is meaningful in that it has analyzed empirically the effects of the tax exemption tax on foreign equity investment only temporarily applied on the fund investment by using the micro data of the fund.
