비영리공익법인의 회계투명성확보와 부패방지 방안 (A study on securing accounting transparency and preventing corruption of non-profit public interest corporations)

초록

경제의 볼륨이 커지고 사회가 다양한 모습으로 빠르게 변화하는 과정에서 각 계층의 요구를 해결하기 위한 공익활동은 정부가 단독으로 감당하기 어렵다. 이로 인해 지난 20여 년 간 공익분야에 대한 정부의 역할을 대행하는 민간비영리 분야가 새롭게 탄생하고 그 역할과 규모는 계속 확대되고 있다. 다양한 사회 구성원의 욕구를 충족하기 위해서는 정부가 생산한 공공재나 서비스의 제공 방식보다는 민간 비영리조직을 통해서 특화된 공공재와 서비스를 공급하는 것이 더 효율적일 수 있다.
그러나 민간비영리조직의 순기능적 역할의 필요에도 불구하고 한국의 비영리단체는 개선하고 보완해야 할 많은 과제를 안고 있다. 그 가운데서도 가장 시급한 문제는 비영리법인의 불투명한 회계를 바로잡는 일이다. 비영리법인의 관리자들은 회계부정을 단순한 실수 혹은 오류라고 변명하지만 실제로는 진실을 숨기기 위한 의도된 행위가 대부분인 것으로 드러나고 있다. 이런 결과가 나타나는 이유는 크게 세 가지로 구분할 수 있다. 첫째, 민주화 과정에서 비교적 기 기간 동안 사회적 이슈를 주도하며 활동한 엔지오 단체들이 권력화 되었다는 사실에 근거를 둔 총체적인 도덕적 해이다. 둘째, 폐쇄적인 자금운영과 부실한 회계처리다. 셋째, 비영리법인을 감독하는 주무관청이 명확하지 많아 그 관리가 근본적으로 허술하다. 게다가 회계처리기준도 일원화되어있지 않다. 넷째, 모금액이 어떻게 사용되었는지에 대해서조차 해당 공익법인의 자체적인 공개에 맡겨지고 있다.
이와 같은 문제를 해결하기 위해서는 기본적으로 공익법인의 회계처리 기준에 관한 교육을 강화하고 비영리법인의 지배구조와 상근임원의 보수를 공개하여야 한다. 동시에 모금가의 양성을 활성화 하고 민간에 의한 감독기구가 구축되어야 한다. 특히 외부감사의 강화는 매우 시급하다. 물론 외부감사를 받아야 하는 규정은 있으나 문제는 외부감사가 의무규정이 아니라는 사실이다. 따라서 이에 따른 적절한 법적인 보완도 요구된다.
이러한 구체적인 방안의 토대 위에서 사회적 관심이 확대된다면 비영리법인의 회계투명성은 빠르게 선명해 질 것이고 더 나아가 국민적 신뢰를 확보하게 될 것이다.

영어초록

In the process of increasing the volume of the economy and rapidly changing society into various forms, it is difficult for the government to handle the public interest activities to solve the needs of each class alone. This has resulted in a new private non-profit sector that acts as an agency for the government in the public interest sector over the past two decades, and its role and scale continue to expand. In order to meet the needs of various members of society, it may be more efficient to supply specialized public goods and services through private non-profit organizations rather than through the provision of public goods or services produced by the government.
However, despite the necessity of the pure functional role of private non-profit organizations, Korean non-profit organizations have many tasks to improve and supplement. Among them, the most pressing issue is correcting the opaque accounting of non-profit corporations. Managers of non-profit corporations excuse accounting fraud as a simple mistake or error, but it turns out that most of them are intentional actions to hide the truth. There are three main reasons for this result. First, it is a total moral hazard based on the fact that the NGO groups that have led social issues for a relatively long period of time in the process of democratization have become the empowered. Second, it is closed fund operation and poor accounting. Third, the management of non-profit corporations is fundamentally poor because the competent authority overseeing non-profit corporations is not clear. In addition, accounting standards are not unified. Fourth, even how the fundraising was used is left to the public interest corporation's own disclosure.
In order to solve such problems, education on accounting standards for public interest corporations should be strengthened and the governance structure of non-profit corporations and the compensation of full-time executives should be disclosed. At the same time, expansion of donors should be promoted and a private supervisory body should be established. In particular, it is very urgent to strengthen external audit. Of course, there are regulations that require external audit, but the problem is that external audit is not a mandatory regulation. Therefore, appropriate legal supplementation is required accordingly.
If social interest is expanded on the basis of these specific measures, the accounting transparency of non-profit corporations will be quickly cleared and furthermore, public trust will be secured.
