情報公開法上 非公開情報에 대한 判例의 檢討 (A Study on Judicial Precedents of Exemption to Disclosure in accordance with the Korea Information Disclosure Act)

초록

정보공개법의 입법과정에서 행정기관은 가급적 비공개의 경향을 보이게 되며, 이로 인해 비공개가 지나치게 확대되는 점이 문제로 지적되고 있다. 실제로 정보공개법에서는 비공개 사유와 범위가 추상적·포괄적이고 모호하다는 지적이 많다. 이런 불확정적인 개념 때문에 공공기관이 비공개 부분에 대해 자의적인 해석을 하고 비공개결정을 하여 소송으로 이어지는데 패소하는 경우가 많다. 이와 같은 추상적·포괄적인 개념들이 규정되어 있는 정보공개법 제9조 제1항의 비공개 사항별로 우리나라와 일본의 판례 검토하고 분석하여 추상적·포괄적인 개념들의 의미는 무엇인지, 그리고 어떻게 구체화되어 가는 지, 정보공개와 관련되어 비교형량을 함에 있어서 어떤 사항들이 검토되는지에 대해 알아보았다. 검토해 보니 판례에 의해 추상적·포괄적이고 모호한 개념에 대해 기준이 마련된 것도 많았지만 여전히 해석의 여지를 남겨놓은 규정들도 많았다. 이를 해결하는 방법은 정보가 공개되고 나면 돌이킬 방법이 없음을 감안할 때 사후적 권리구제 보다는 사전적인 권리구제가 중요하기 때문에 비공개사유에 대한 세부적인 기준을 세우는 것이 필요하다. 이런 세부기준을 마련할 때에는 대외적 구속력이 없는 행정규칙으로 할 것이 아니라 지금까지 정립된 이론이나 판례를 토대로 시행령이나 시행규칙으로 규정할 필요가 있다.

영어초록

An administrative authority tries to, or at least tends to, be of non-disclosure during the enactment of information disclosure act, which is why it's controversial to excessively extend non-disclosure in terms of its legal interpretation; actually, they point out that reasons for, and the scope of, non-disclosure specified by the same act are abstract, comprehensive and vague. An "indefinite" aspect of the term has caused public institutions to make, in accordance with their own arbitrary interpretation, decisions on a basis of non-disclosure, which, in turn, leads to a suit against them that would end up losing the suit.
With regard to such exemptions to disclosure, this study reviews and analyzes their judicial precedents from South Korea and Japan by case of non-disclosure whose abstract and comprehensive concepts are provided by the clause 9.1 of the Korea Information Disclosure Act, aiming to identify what they imply, how they can be concretized, and what kinds of considerations are referred to in pronouncing comparative sentences related to information disclosure.
As a result of analyzing those precedents, it's been found that there are lots of clauses yet to be more concretely interpreted, although somewhat concrete criteria have been provided through related precedents. To solve such problems, there is a need to establish detailed criteria for reasons for non-disclosure, since ex ante remedies rather than ex post ones are more important in that there is no way to, if information has been disclosed, put such situation back as they were not. It's recommended that enforcement ordinances or regulations based on well-established theories or precedents, not administrative rules without any enforcement, be provided in establishing such detailed criteria. For the purpose, it's expected that this study will help do so such as it is.
