의정활동비의 지급기준액 결정에 관한 고찰 (A Study on the Determination of the Payment Basis for Legislative Activities)

초록

지방자치법상 의정활동비는 지방의회의 의원의 의정조사수집·연구비와 보조활동비의 비용을 전보하기 위한 명목으로 지급하고 있다. 지방자치법에서는 의정활동비의 지급상한을 대통령령에서 정한 기준의 범위 내에서 조례로 정하도록 하고 있고, 의정활동비의 지급액을 의정비심의회에서 결정하는 경우 지방자치단체의 재정능력 등을 고려하되, 공청회 또는 주민의견 수렴절차를 통하여 주민의 의견을 반영하도록 하고 있다. 의정활동비의 법적 성질은 학설은 비용전보설, 보조금설, 실질적 급여설, 비증여설 등이 대립하고 있으나, 헌법재판소와 대법원은 지방의원의 의정활동의 대가로 지급하는 급여가 아니고 비용전보설 입장을 취하고 있다. 의정비심의회가 지방자치법령과 조례에서 정한 절차를 밟은 경우에는 특별한 사정이 없는 한 지방자치법시행령에서 정한 기준의 최고액으로 결정한다고 하더라도 재량권의 일탈남용으로 볼 수 없고, 이를 조례에 반영한다고 하더라도 위법한 조례라고 볼 수 없다. 이러한 까닭에 2023.12. 지방자치법시행령에서 의정활동비의 지급기준의 상한을 확대하였는바, 의정심의회에서 주민공청회를 거쳐 최고 한도로 결정하고 조례로 정하고 있는 실정이다.
한편, 독일은 지방의회의원을 명예직으로 이해하여 의정활동비를 인구수에 비례에서 월정액으로 지급하고 있으나, 우리나라의 경우와 같이 의정활동비를 현실화하여 지급하지 않고 있다. 또한 일본에서는 지방자치법에서 정무활동비를 지방자치단체의 실정에 따라 자율적으로 조례로 정무활동비의 지출범위를 규정하고, 조례에 정하는 바에 따라 정무활동비 수입지출보고서를 지방의회의장에게 제출하도록 하고 있을 뿐만 아니라 투명성을 확보하도록 규정하고 있다. 일본의 지방자치단체에서는 정무활동비를 지방자치단체의 인구의 수에 비례하여 지방자치단체의 실정에 적정하게 의원들에게 지급하고 있는 바, 정무활동비의 지출기준과 절차등을 조례와 지침에서 명확히 규정하여 정무활동비의 적정성과 투명성을 확보하고 있다.
따라서 의정활동비의 법적성질이 지방의회의원의 급여가 아니라 의정활동에 따른 비용지출을 전보해준 것이므로 일본의 입법례와 같이 지방자치법에서 의정활동비의 지급대상과 지급방법, 비용지출범위, 의정활동비 수입지출보고서 제출 및 공개의무, 의정봘동비의 반환에 관한 사항을 조례에서 정하도록 명시하도록 하고, 의정활동비의 비용지출기준과 범위, 절차 등은 의정활동비조례시행규칙과 지침에서 구체적으로 정하여 지방자치단체의 자기결정권과 자기책임성을 확보하여야 할 것이다.

영어초록

According to the Local Autonomy Act, legislative activity expenses are paid in the name of transferring the expenses of legislative investigation and research expenses and subsidized activities of local council members. The Local Autonomy Act requires that the upper limit on the payment of legislative activity expenses be determined by ordinance within the standards set by the Presidential Decree, and when the Legislative Improvement Council decides the amount of legislative activity expenses, the financial capacity of local governments shall be considered, but the opinions of residents shall be reflected through public hearings and resident opinion collection procedures.
The legal nature of legislative activity expenses is in conflict with the theory of cost transfer, subsidy, actual salary, and non-donation, but the Constitutional Court and the Supreme Court are taking the position of cost transfer, not the salary paid in return for the legislative activities of local lawmakers. Where the Legislative Improvement Council has taken procedures prescribed by local government laws and ordinances, it cannot be regarded as a deviation or abuse of discretion, unless there are special circumstances, and even if it is reflected in the ordinance, it cannot be regarded as an illegal ordinance. For this reason, the Enforcement Decree of the Local Autonomy Act expanded the upper limit of the payment standard for legislative activity expenses, and the Legislative Council has decided to set the maximum limit after a public hearing for residents and set it as an ordinance.
Germany understands local council members as honorary positions and pays parliamentary activity expenses in proportion to the population, but does not pay parliamentary activity expenses as in Korea. In Japan, the Local Autonomy Act stipulates the scope of political activity expenses autonomously by ordinance according to the situation of local governments, and requires the chairman of the local council to submit a report on income and expenditure of political activity expenses as prescribed by the ordinance, as well as to secure transparency. Local governments in Japan pay political activity expenses appropriately to lawmakers in proportion to the number of local governments' population, and the standards and procedures for spending political activity expenses are clearly defined in ordinances and guidelines to ensure the appropriateness and transparency of political activity expenses, As the legal nature of legislative activities transfers the expenditure of legislative activities, not the salaries of local council members, as in Japanese legislation, the Local Autonomy Act shall specify matters concerning the payment of legislative activities, the scope of expenditure, the obligation to submit and disclose income expenditure reports on legislative activities, and the return of legislative expenses, and the standards, scope, and procedures for expenditure of legislative activities shall be specifically determined in the Enforcement Rules and Guidelines of the Legislative Activities Ordinance to secure the right to self-determination and self-responsibility of local governments.
