200해리 이원에 존재하는 대륙붕에 대한 중첩된 권원과 대륙붕한계위원회 역할의 한계 (Limitations Placed on the CLCS in Settling the Issue of Overlapping Entitlements to the Continental Shelf Beyond 200NM)

초록

대륙붕한계위원회가 200해리 이원의 대륙붕의 외측한계에 관하여 권고를 부여하는 것과 국제재판소가 200해리 이원의 대륙붕에 대한 경계획정을 하는 것은 별개의 절차이다. 따라서 200해리 이원의 대륙붕에 대하여 두 개 이상의 연안국들이 중첩된 권원을 가지고 있는지가 불분명할 때 그리고 중첩된 권원의 존재가 전제되고 있을 때조차도 어떤 절차가 우선시되어야 하는지에 관하여는 의문이 생길 수 있다.
본 논문은 우선 대륙붕한계위원회의 구성 및 위원회가 발하는 권고의 법적 의의에 대한 분석을 통해 200해리 이원의 외측한계설정은 위원회의 권고에 기초하여 여전히 ‘국가’가 행하는 것이라는 점과, 대륙붕한계위원회의 권고는 제3국의 권리를 침해할 수 없기 때문에 경계획정에 영향을 미칠 수 없다는 것을 검토하였다. 그리고 2006년 Barbados/Trinidad and Tobago 중재사건 이후 특별히 가장 최근에 주어진 2012년 ITLOS의 Bay of Bengal 사건까지 국제재판소의 결정들을 분석하여 200해리 이원의 대륙붕에 대한 중첩된 권원과 관련될 수 있는 문제를 해결할 수 있는 방법을 정리하였다.
가장 좋은 방법은 국제재판소가 ‘일차적으로’ 200해리 이원의 대륙붕에 대한 경계선의 ‘방향’을 결정하면 이에 따라 대륙붕한계위원회가 외측한계설정에 관한 권고를 주는 것이다. 이것은 200해리 한계선까지 경계선이 그려져야 분쟁당사국들 모두 또는 어느 일방만이 200해리 이원의 대륙붕에 대한 자연적 연장을 가지는지가 확인되기 때문이다. 그 이후 ‘이차적으로’ 대륙붕한계위원회는 외측한계에 대한 권고를 줄 수 있다. 이를 통해 200해리 이원의 대륙붕에 관한 중첩된 권원 문제를 해결하는데 있어 대륙붕한계위원회의 ‘한계’가 증명되는 것이다.

영어초록

There are two separate procedures in international law which deal with the continental shelf beyond 200NM. One is that the CLCS makes recommendations to a coastal State on matters related to the outer limits of the continental shelf beyond 200NM; the other is that international courts and tribunals make binding decisions regarding the delimitation of the outer continental shelf. At the moment, there arises the question as to which of the two procedures must first be followed when it is doubtful whether overlapping entitlements to the outer continental shelf exist at all, and also when entitlements of two coastal States to the same outer continental shelf overlap.
By pointing out the absence of international lawyers within the CLCS and analysing the meaning of the Commission’s recommendations and the relevant provisions of the 1982 UNCLOS, it is then submitted that only ‘States’ (not the CLCS) establish the outer limits of the continental shelf beyond 200NM on the basis of the recommendations, and that the CLCS’ recommendations are without prejudice to the delimitation of the outer continental shelf because they should not affect third-State rights. Moreover, this article shows how to settle the issue of overlapping entitlements to the outer continental shelf by analysing the decisions of international courts and tribunals including the most recent international case, the 2012 Bay of Bengal case of the ITLOS.
The best solution is for international courts and tribunals to first decide the ‘direction’ of a line delimiting the outer continental shelf. Subsequently, the CLCS may make recommendations regarding the outer limits of the continental shelf beyond 200NM. The reason for this is that the natural prolongation of a coastal State to the outer continental shelf can only be verified when a delimitation line is constructed up to the 200NM limit line. It proves that there are limitations placed on the CLCS in dealing with the issue of overlapping entitlements to the continental shelf beyond 200NM.
