국가질서와 시민불복종의 연구 : 소로우(H. D. Thoreau)의 사상을 중심으로 (A Study on the Nation’s Order and Civil Disobedience : Focus on Thoreau’s Thought)

초록

주지하는 바와 같이 미국의 근대국가의 형성 및 발전과 밀접한 관련이 있는것이 바로 로크의 사회계약론이라 할 수 있다. 사회계약론은 국가이전의 상태혹은 국가가 존재하지 않는 상태에서 나타나는 위험을 극복하기 위하여 인간의이성과 합리성에 기초를 둔 국가질서의 필요성을 전제로 하고 있다. 그러나 미국은 이와 같은 이성과 합리성에 기초를 두었음도 불구하고 사회계약론을 왜곡하여 노예제도라는 비인간적이고 부정의한 제도를 오랫동안 유지해 온 것이 사실이다.
소로우는 이러한 문제를 극복하기 위하여 로크의 사회계약론을 토대로 하여국가질서를 설명하고자 하였다. 즉, 사회계약론에 의하면 모든 인간은 자유롭고독립적이며, 따라서 정부는 개인의 삶과 자유, 그리고 재산을 보호하기 위하여설립되어야 한다는 것이다. 그리고 소로우는 사회계약론에 의한 국가질서의 한계를 극복하기 위하여 에머슨의 초월주의를 원용하였는데, 이에 따르면 인간은정치적으로 국가와 동등한 존재이며, 따라서 개인은 그러한 역량을 가지고 부정의한 정부에 효과적으로 대항할 수 있다고 보았다. 소로우는 사회계약론과 초월주의를 결합하여 시민불복종론을 전개하였는데, 여기에서 그는 평화적인 혁명을제시하였다(그러나 한편으로는 양심이 다쳤을 때, 양심을 지키기 위해 비상사태시에 어느 정도의 폭력이 존재할 수밖에 없음을 비유적으로 암시하였다). 큰 틀에서 볼 때 소로우의 사회참여이론은‘영웅주의’라고 요약할 수 있다고 본다.
그에게 있어서 영웅은 엘리트주의와는 거리가 먼 개념이며, 이는 양심을 가진 사회구성원으로서 사회의 불의를 목격했을 때, 저항의사를 표시할 수 있는 모든개인을 의미한다고 할 수 있다.
국가질서와 시민불복종 문제는 오늘날 집회시위가 끊임없이 발생하고 있는 치안현장에서 경험하고 있으며, 이의 해결의 실마리는 보이지 않는 것이 현실이다.
이 문제(특히, 폭력적 시위)를 해결하기 위해서는 국가공권력과 이해관계집단이각자의 정치적ㆍ형식적 명분을 내세워 반목하기보다는 상호간에 국가질서의 기본적 정체성을 다시한번 재인식하는 계기를 모색해야 한다고 본다. 따라서 시민불복종론이 무조건적으로 시위대의 국가공권력을 무력화하는 정당화 논리로 변질되어서는 안 된다고 본다. 중요한 것은 법 이전에 도덕과 양심에 기초를 둔국가질서의 정체성을 재확립하는데 있기 때문이다.

영어초록

As everyone knows, the thoughts that are closely related to the establish and development of modern America are Locke’s social contract theory.
Social contract theory was predicated on the premise that the necessity of nation’s order based on human’s reason and rationality to overcome the risks or dangers caused by the situation of pre-nation or no-nation. But,although based on the reason and rationality, some people distorted the social contract theory and supported the slave system for a long time which are inhuman and unjust in itself.
Thoreau tried to showed the nation’s order by reinterpretation of social contract theory for these problems. By social contract theory, all men are free and independent and that the government is must be established for the purpose of protecting the people’s lives, liberty, and estate. Thoreau then turned to Emerson’s transcendentalism to overcome the limitation of nation’s order established by the social contract theory. This philosophy defined the individual as politically equivalent to the nation, thereby assuming that one person’s secession could effectively disintegrate a unjust and corrupt government. Thoreau integrated social contract theory and transcendentalism, and then developed the theory of civil disobedience, in here, he said the peaceable revolution. While, when the consciences are seriously hurted in national emergency, he suggested figuratively that people can’t help using the violence to the government. In fact, We can summary that Thoreau’s the whole of the theory of social participation are heroism. Of course, the hero is not elitism, but every individual that symbolize the people who have conscience when he see the social unjustice, and can show the resistance by both spirit and action.
In fact, the problem of nation’s order and civil disobedience are very frequently occurred in the scene of the assembly and demonstration in today, and it is hard to find the clue of its solution. To solve these problems(especially, in the violent demonstration), we must sublate the conflict between the nation’s power and interest groups caused by political ㆍformal justification, and find the chance that can recognize the original identity of national’ order each other again. Therefore, we must remember that the civil disobedience must not be used by the absolutely means which incapacitate the nation’s official power. More important thing is to recognize the identity of the nation’s order which are based on the morality and conscience before the law.
