북한 정권 불확실성에 따른 국가정보원 대공수사권 필요성 분석 (Analysis of the Necessity of the National Intelligence Service's Counterintelligence Investigation Authority Due to Uncertainty in the North Korean Regime)

초록

북한 정권의 불확실성으로 탈북이 세대를 거듭하며 진화하고 있는 시점에서 국가정보원 의 대공수사권 폐지는 우리 사회의 자유민주적 기본질서를 위협하는 세력에 대한 방어력을 약화시키고 있다는 지적이다. 이러한 목소리는 학계에서 더 많이 논의되어야 하지만 국가보안법 7조에 해당하는 대공수사권에 관한 연구는 편향되어 있고 또한, 지금까지 북한 이탈주민과 관련된 연구는 주로 한국사회의 정착과 지원 등에 관련된 연구가 대부분이었다. 따라서 본 연구에서는 2024년 기준 한국에 정착해 있는 3만 4천 명의 북한이탈주민을 보호하는 보안경찰관의 스트레스가 북한이탈주민의 인식에 미치는 영향 분석을 근거로 국가정보원 대공수사권의 필요성을 제언하였다. 이러한 연구의 목적을 위하여 첫째, 연구에 참여한 보안경찰관의 일반적 특성 파악을 위하여 빈도분석(Frequency Analysis)을 실시하였다. 둘째, 설문의 신뢰도 검증을 위하여 Cronbach's α계수를 산출하였다. 셋째, 보안경찰관의 스트레스 구성개념의 타당도를 탐색하기 위하여 탐색적 요인분석(EFA)을 실시하였다. 넷째, 보안경찰관의 스트레스와 북한이탈주민에 대한 인식 간의 상대적 영향력을 파악하기 위해 상관분석을 실시하였다. 다섯째, 보안경찰관의 스트레스가 북한이탈주민에 대한 인식에 영향을 미치는지 알아보기 위해 단순선형회귀분석을 실시하였다. 여섯째, 요인분석 (EFA) 결과를 기초로 반구조화된 면담(Semi In-Depth Interview)을 실시하였다. 연구결과, 보안경찰관의 스트레스에 대한 요인분석(EFA) 하위요인은 ‘업무책임’, ‘업무비중’, ‘업무지 시’로 각각 명명되었고 이러한 보안경찰관의 스트레스와 북한이탈주민 에 대한 상관관계는 r=0.553, p=0.000로 유의미한 상관관계가 확인되었으며, 회귀분석 결과 =0.306으로 30.6%의 설명력을 확인하였다. 그리고 반구조화된 면담에서는 보안경찰관 1명이 40~50건 의 사건이 무차별적으로 배당되고 있는 포화상태의 수사 업무 현황과 북한이탈주민 30~40명을 보호해야하는 비현실적인 가혹한 근무환경을 지적하였다. 이 연구에서는 2024년 1월 이후 국가정보원의 대공수사권 폐지 이후 국가정보원으로부터 수백건의 첩보를 경찰이 이첩받아 수사를 진행하였지만 실제로 검찰에 넘긴 사건이 한 건도 없었다는 수사 현황과 최근 우크라이나-러시아 전쟁이 발생하기 10년전 러시아가 우크라이나에서 수행한 회색지 대전술(Grey Area Tactics)을 통해 전쟁으로 전개된 사례에서 한국이 우크라이나와 동일한 지정학적 완충국(Buffer State)이라는 특징을 고려할 때 경찰뿐만 아니라 국가정보원에서도 대공수사권를 집행할 수 있는 법적 권한 부여의 필요성의 근거를 제시하였다.

영어초록

At a time when defections are evolving generation after generation due to the uncertainty of the North Korean regime, the abolition of the National Intelligence Service's counterespionage investigation authority is said to be weakening our defense against forces that threaten the basic order of liberal democracy in our society. Although such voices should be discussed more in academia, research on the counterintelligence investigation authority corresponding to Article 7 of the National Security Act is biased, and most research on North Korean defectors to date has been related to their settlement and support in South Korean society. Therefore, this study suggested the necessity of the National Intelligence Service’s counterintelligence investigation authority based on an analysis of the impact of the stress of security police officers protecting 34,000 North Korean defectors who have settled in South Korea as of 2024 on the perception of North Korean defectors. For the purpose of this study, first, frequency analysis was conducted to identify the general characteristics of the security police officers who participated in the study. Second, Cronbach's α coefficient was calculated to verify the reliability of the questionnaire. Third, exploratory factor analysis (EFA) was conducted to explore the validity of the stress construct of security police officers. Fourth, correlation analysis was conducted to identify the relative influence between security police officers' stress and their perception of North Korean defectors. Fifth, simple linear regression analysis was conducted to determine whether security police officers' stress affects their perception of North Korean defectors. Sixth, Semi In-Depth Interviews were conducted based on the results of factor analysis (EFA). As a result of the study, the sub-factors of the factor analysis (EFA) on the stress of security police officers were named as ‘work responsibility’, ‘work proportion’, and ‘work instructions’, respectively, and the correlation between the stress of security police officers and North Korean defectors was confirmed to be significant at r=0.553, p=0.000, and the regression analysis result confirmed an explanatory power of 30.6% at =0.306. In addition, in the semi-structured interview, they pointed out the saturated investigative work situation where each security police officer is indiscriminately assigned 40 to 50 cases and the unrealistically harsh working environment where they have to protect 30 to 40 North Korean defectors. This study suggests the basis for the necessity of granting legal authority to the National Intelligence Service as well as the police to exercise counterintelligence investigation authority, considering that although the police have investigated hundreds of cases of intelligence transferred from the National Intelligence Service since the abolition of the service's counterintelligence investigation authority in January 2024, not a single case has actually been handed over to the prosecution, and that Korea is a geopolitical buffer state like Ukraine, given the case in which the gray zone tactics Russia carried out in Ukraine 10 years before the recent Ukraine-Russia war led to war.
