장애인의 시민불복종과 연민의 역학 ―‘지하철 행동’ 현장으로부터 (The Dynamics of Civil Disobedience and Compassion in the Disability Rights Movement ― From the Site of the Subway Protest)

초록

이 연구는 2021년 12월부터 시작된 전국장애인차별철폐연대(전장연)의 ‘지하철 행동’을 중심으로, 장애인권리운동의 불복종 전략과 그 배경에서 작용한 연민이라는 감정의 관계를 탐구 한다. 지하철 행동은 장애인에 대한 연민에 근거하여 형성, 운영되던 공공과 민간의 자선 프로그램에 맞서 구체적인 법적 권리를 정립해 온 장애인권리운동의 계보를 잇는 정치적 저항운동이다. 특히 장애인을 종속적인 체제 아래서 억압받는 소수자 집단으로 정체화하는 소수집단 모델에 기초한 장애인권리운동은, ‘합리적 편의 제공’ 법리를 중심으로 권리 기반의 반차별 규범을 정립하는 데 큰 영향을 미쳤다.
누스바움은 사상사 속에서 인간의 취약함을 강조하는 연민 친화적 전통과 개인의 온전성을 운(fortune)에 종속시킨다는 이유에서 인간의 내적 자유와 양도 불가능한 존엄성을 위해 연민에 맞서야 한다는 반-연민 전통을 소개한다. 장애인권리운동은 반-연민 전통에 입각한 장애의 존재론 위에서 연민 친화적 전통이 강조하는 인간의 취약함에 대한 기본적 보호를 동시에 주장해야 하는 입장에서 전개되었다고 말할 수 있다.
소수집단의 역사와 경험에 의지하는 지하철 행동의 규범적 전제는, 양도 불가능한 개인의 존엄성에 대한 강조, 연민에 대한 강렬한 반감으로 장애 개념을 인간의 다양성과 취약성 일반의 표지로 확장하는 일을 방해한다. 이에 따라 장애를 인간의 보편적 조건에 연결하는 장애의 보편주의 모델이 요청되는데, 그에 기초할 경우 지하철 행동에서 수행된 불복종 전략의 규범적 정당화는 더욱 어려워지는 문제에 직면한다. 이런 가운데, 소수집단 모델의 성립 조건으로서 요청되던 반-연민 전통에도 불구하고 지하철 행동의 시위자들이 어느 날 기꺼이 연민을 감수하는 시위방식을 선택했다. 이러한 시위 방식은 연민을 불러일으키는 인간의 취약성과 연민을 감수하는 자의 존엄성을 동시에 드러내는데, 이를 통해 소수집단 모델의 한계를 초월하고 비설득적인 불복종 전략에서 설득적인 불복종 전략으로 이행될 가능성을 확보하게 된다.

영어초록

This study explores the relationship between disobedience strategies in the disability rights movement and the role of compassion, focusing on the “Subway Protest” initiated by the Solidarity Against Disability Discrimination (SADD) in December 2021. The Subway Protest was a form of political resistance that continued the legacy of the disability rights movement, which challenged public and private charity programs rooted in compassion for persons with disabilities, instead seeking to establish concrete legal rights. Especially based on the minority group model, which identifies persons with disabilities as an oppressed social minority under a subordinating system, the movement played a crucial role in developing anti-discrimination norms grounded in the right to “reasonable accommodation.” Martha Nussbaum distinguishes between two intellectual traditions: one that affirms human vulnerability through compassion, and another that opposes compassion on the grounds that it subjects human integrity to fortune and undermines inner freedom and inalienable dignity. The disability rights movement unfolds at the intersection of these traditions―while grounded in ontology of disability of the anti-compassion tradition, it nonetheless demands fundamental protection for human vulnerability, a value emphasized by compassion-oriented thought.
The normative premise of the Subway Protest, which draws on the historical and political experience of minority groups, emphasizes the inalienable dignity of individuals and resists compassion. This resistance, however, poses a challenge to expanding the concept of disability to encompass universal human vulnerability and diversity. In response, a universalist model of disability is needed. Yet, under such a model, the normative justification for acts of civil disobedience like the Subway Protest becomes more difficult.
Amidst this tension, despite the anti-compassion tradition underpinning the minority group model, protesters at times willingly embraced strategies that invoked compassion. These actions revealed both the vulnerability that evokes compassion and the dignity of those who accept it, thereby transcending the limitations of the minority group model and opening the possibility for the Subway Protest to transition from a non-persuasive to a persuasive strategies of civil disobedience.
