경찰학적 관점에서의 경제불황기 치안정책의 모델연구 (A Study on the Public Order Policy Model under an Economic Recession from the Perspective of Police Science)

초록

본 연구는 불황기에 증가하는 범죄에 대한 치안정책 모델을 제안하고자 하였다. 치안정책은 법집행, 질서유지, 공공봉사의 경찰활동에 대한 목표와 수단으로서 범죄에 대한 통제 기능을 수행하는 형사정책과 다르다.
최근 한국의 대표적 불황기는 1988~ IMF관리체제, 2004~ 경기하강 제2의IMF 시대, 2008~ 외환위기의 시기라 할 수 있다.
경제가 불황국면일 때는 투자의 감퇴, 생산 ․ 소비의 감소, 실업 ․ 도산의 증가,임금 ․ 물가 ․ 주가 ․ 금리 등이 저하되는 현상이 나타나지만, 가장 두드러진 지표는기업이윤이 감퇴되어 가정파괴, 생계형범죄 등이 증가한다는 것이 지금까지의연구 결과이다.
경제와 범죄의 관련성은 첫째, 경기변동과 범죄의 관계 면에서 범죄가 증가한다는 정비례이론과 감소한다는 반비례이론이 있다. 둘째, 경제여건과 관련성에서엑스너는 인플레이션은 범죄에 중요한 변동을 가져왔다고 설명하고, 렝거의 연구는 소득과 범죄의 관계는 불투명한 것으로 조사되었다. 셋째, 엘리히는 빈곤과범죄 간에 비례적인 상관관계가 발견되었다고 주장하였다. 또한 버어트, 봉거,글뤽부처 등도 빈곤이 범죄와 상관관계가 있다고 주장하였다. 넷째, 1970년대와1980년대에 행해진 많은 연구들은 경제적 불평등이 살인범죄의 발생율과 정비례의 관계에 있다는 결론을 도출하였고, 토비는 절대적인 빈곤 그 자체보다 다른사람들과 비교하여 느끼는 상대적 결핍의 감정이 범죄에 영향을 미친다고 주장하였다.
범죄학적 범죄예방모델로는 억제이론, 치료 및 갱생이론, 상황적 범죄예방이론, 사회적 발전모델을 들 수 있으며, 영역별(단계별) 범죄예방모델은 제1차 범죄예방, 제2차 범죄예방, 제3차 범죄예방이 있다.
경찰활동모델은 특징을 중심으로 구분할 수 있는데, 그 중 하나가 미국을 중심으로 한 모델이며, 최근 네크워크 중심 행정이론에 근거한 범죄예방망 모델이 있다. 범죄예방을 위한 주요 전략으로는 ① 체포확률 우선전략, ② 공동체 민간참여와 자원봉사 전략, ③ 경찰대응력 강화 전략, ④ 법 준수율 제고전략, ⑤ 문화의적응성과 통합 전략, ⑥ 사회계층 계급간 갈등의 협상전략, ⑦ 사회적 약자의 회피 전략, ⑧ 범죄원인 제거의 사회체제적 통합 전략을 들 수 있다.
관련연구와 범죄분석 결과 ① 불경기와 범죄는 상관관계가 있다는 점, ② 신종범죄가 등장한다는 점, ③ 각 범죄별 예방 전략이 필요함을 시사점으로 얻을수 있었다. 또한 경찰정책 대안의 개발 원천은 ① 과거의 정책목록, ② 타국의정책, ③ 새로운 이론이나 기술, ④ 직관적 방법(델파이, 브레인스토밍) 등을 활용할 수 있다.
불황기에도 경찰활동은 기존의 활동을 계속하지만, 위기관리적 관점에서 강화해야 할 경찰활동으로 ① 상황대응적 치안활동, ② 지역사회 협력활동, ③ 사회적 약자 보호활동을 제언하였다.

영어초록

The purpose of this study is to propose a model for the Public Order Policy in response to the rapidly increasing crime under the current economic recession. The Public Order Policy can be a goal and at the same time a means to realize objective such as the law enforcement,maintenance of order, and public services, which is differentiated from the Criminal Justice Policy that is solely dedicated to the control of the crimes.
The economic recessions Korea has been and is faced with now can be,respectively, from 1988 to the IMF Bailout program, from 2004 to another economic down turn (or the 2nd IMF Period),and lastly from 2008 to the recent financial crisis.
When there is an economic recession, according to the existing studies,various social phenomena such as reduced investment, damages in production and consumption, increased bankruptcy and unemployment may occur. At the same time, the incomes, stock prices, interests goes down to further accelerate the economic turmoil. However, what is the most noticeable in this situation is the destruction of the families and increases in the crimes as a means of living, according to the results of the studies so far. There are to theories that concerns the relationship between the economy and the crimes. That is, some believe that the economic fluctuation positively contributes to the increase of the crimes, while others say the crimes actually decrease during such economic downturns.
Secondly, Exner explained that the inflations brought about significant changes in the trends of the crimes, and Renger revealed that the relationship between the income and the crime is rather vague. Thirdly,Ehlich asserted that there is a positive correlation between poverty and the increase in the crimes. Similarly Burt, Bonger and Glueck and Glueck also maintained that crime is in positive proportion to poverty. Fourthly,many studies conducted during 1970s and 80s concluded that the economic inequality resulted in positive proportion to the rate of homicidal crimes. Toby, in this regard, claimed that it is not the extent of the absolute poverty but, instead, the perceived relational level of poverty that affected the crime rates.
The crime prevention models in the criminology can be, namely, control theory, cure and rehabilitation theory, circumstantial prevention theory, and social development theory. The prevention models for progressive prevention models are respectively Primary Prevention, Secondary Prevention, and 3rdStep Prevention.
The models of the Police Activities can be categorized by their characteristics. One of them is the American Model, and there are also other recent Crime Prevention models based on the Network Oriented Administrational Theory.
Major strategies for the prevention of the crimes are, respectively, (1)Arrest-Rate Oriented, (2) Community Participation and Volunteer Strategy,(3) Enhancement of Police Responsiveness, (4) Improvements in the Law Compliance, (5) Integration and Cultural Adaptation, (6) Negotiation Strategy to defuse the conflicts between different social classes, (7)Evasion Strategies for the minors in the society, (8) Elimination of the Crime Sources and Integration in the context of the Social System.
The analysis of the crimes in the related studies showed that, (1) there is a correlation between the economic downturn and the crimes, (2) new types of crimes may appear, (3) preventive strategies for each type of the crimes may be needed. Also, the development sources of the law enforcement policy were, (1) the list of the policies in the past, (2) case policies in foreign countries, (3) new theories or technologies, (4) intuitive approaches (Delphi or Brainstorming), which were indentified as a result of the said analysis.
The Police ought to continue what they usually do even in the economic downturns. However, in the perspective of the crisis management, police activities such as (1) Case-by-Case Responses, (2)Cooperation with the Local Communities, (3) Protection of the minorities (or the‘Weaks’) in the society were suggested to be fortified.
