공정이용제도 불확실성 해소방안에 관한 연구 (Legal Issues about Uncertainty of Fair Use in Copyright Law)

초록

한미 FTA협상 결과를 반영하여 현재 저작권법 개정안에서는 미국 저작권법과 유사한 형태의 공정이용조항을 마련하고 있다. 그러나 한국과 미국의 사법체계의 이질성으로 말미암아 미국법상의 공정이용제도를 우리나라에 그대로 도입할 경우 그 실효성을 담보하기가 어려울 것이라는 비판적 견해가 있다. 따라서 공정이용규정의 도입이 우리나라 저작권 체계에 미치는 영향을 득과 실로 나누어 파악해 보고, ‘득’이 되는 부분은 최대한 살리면서 ‘실’이 되는 부분을 보완하는 도입방안을 마련할 필요가 있다. 현행의 엄격한 저작권 제한조항이 가지고 있는 간극을 메우면서 빠른 기술변화에 따른 저작권 권리관계에 대처하기 위해서는 권리자에게 실질적 손해를 입히지 않는 형태의 저작물 이용을 합법화 할 수 있는 융통성 있는 수단이 필요하다. 이때에는 일반적 공정이용 조항의 “불명확성”이 “득”으로 작용할 것이다. 그러나 저작물 이용자가 공정이용 해당여부에 대하여 합리적으로 예측할 수 없는 경우에는 그러한 공정이용 규정의 도입은 무용지물이 될 것이다. 따라서 일반적 공정이용 규정의 특성인 “불명확성”의 한계를 적절히 설정함으로서 공정이용제도를 탄력 있게 운영함과 동시에 예측가능성도 확보할 수 있도록 하는 방안이 필요하다. 이러한 방안으로서 공정이용의 판단요소로서 ‘저작권 향유 시간’을 고려할 것과 ‘공정이용심의제도’의 도입을 제안한다. 공정이용을 판단함에 있어서 대상이 되는 저작물의 권리향유기간을 고려한다면, 장기화된 독점적 권리의 제한원리로서 공정이용원리가 효율적으로 작동할 수 있을 것이다. 또한 저작물은 그 존속기간이 만료될 때 까지 보호되나, 그 보호의 정도는 존속기간의 경과에 따라 달라질 수 있으므로 현행의 획일화된 보호기간을 보완 할 수 있는 바람직한 방안이 될 수 있다. 또한 공정이용의 판단기준인 4가지 요건의 불명확성을 현실적으로 구체화 시킬 수 있는 또 다른 기준으로 작용할 수 있을 것이다. 한편, ‘공정이용심의제도’란 타인의 저작물을 공정이용을 하고자 하는 자가 그가 하고자 하는 이용이 공정이용에 해당하는지에 대하여 이용 전에 ‘공정이용사전심의위원회’에 의견을 구하는 제도로서, 공정이용사전심의위원회가 공정이용에 해당하는지 여부를 판단하여 그러한 판단결과를 저작권자와 신청자에게 통보하는 제도를 말한다. 이러한 제도가 도입된다면 잠재적 이용자들에게 공정이용의 불확실성으로 인해 제기될 문제점을 해소시켜줌으로서 이용의 효율성을 높여 줄 수 있을 것으로 기대한다.

영어초록

According to Article 18.4 : 1 of Free Trade Agreement between the Republic of Korea and the United States of America, it is stated that “Each Party shall provide that authors, performers, and producers of phonograms have the right to authorize or prohibit9 all reproductions of their works, perfomances and phonograms, in any manner or form, permanent or temporary (including temporary storage in electronic form). And its footnote states “Each Party shall confine limitations or exceptions to the right described in this paragraph to certain special cases that do not conflict with a normal exploitation of the work, performance, or phonogram, and do not unreasonably prejudice the legitimate interests of the right holder. For greater certainty, each Party may adopt or maintain limitations or exceptions to the right described in this paragraph for fair use, as long as any such limitation or exception is confined as stated in the previous sentence.” So Article 18.4:1 and its footnote clearly points out that the limitations and exceptions for the right of reproduction can be adopted or maintained within obeying the three step test stated in Article 9 of Bern Convention. In other words, no obligation to install the system of fair use is given to the parties in this agreement. However, reflecting the trend of implementation of legislating to regard temporary storage as illegal reproduction and the requests of the intensified protection of copyrights, it is afraid that the loss of balance to hamper the fair use of the users may occur by focusing only on the protection of right of author if the system of fair use is not adopted. Therefore there are some views that it is reasonable to introduce the provision of fair use in the comprehensive form. Likewise, considering the results of Free Trade Agreement between Republic of Korea and USA, the present revision of copyright law is trying to accept the provision of fair use which is similar to the system of fair use of USA. Still, there are some concerns whether the effectiveness of introducing the system of fair use of copyright law of USA can be secured or not since the judicial climate or environment of Republic of korea is very distinct from that of USA.
All in all, this thesis suggests the solution to promote the advantage and compensate the defect after figuring out the gains and losses that the general provision of fair use can bring to the mechanism of copyright law. For these discussions, I basically examined over the meaning of fair use and analyzed the advantage and disadvantage accompanied with the adoption of fair use of copyright law of USA and then specifically elaborated on the solutions to resolve the uncertainty which is the essential cause for generating the advantage and the disadvantage.
