사회 위기의 극복 전략으로서 지방분권과 보충성 원리 :자기준거적 체계이론의 관점에서 (The Decentralization and Subsidiarity Principle as Strategies to Overcome Societal Crises :From the Viewpoint of Selfreferential System Theory)

초록

세계사회는 중앙집중화에 따른 사회 위기를 해결하기 위해 중앙집권에서 지방분권으로의 국가변형이 일어나는 추세에 있다. 지방정치의 분화는 지방분권을 전제로 하고, 지방분권은 단지 국가에서 지방으로의 권한이양만이 아니라 국가의 통제로부터 자유로운 지방의 출현도 지향한다. 이의 실천을 위하여 유럽 연합은 마스트리히트조약과 리스본조약의 형식으로 연합-회원국 관계에 보충성 원리를 도입한다. 나아가 지방분권의 성공적인 제도화를 위해 일부 유럽 국가들은 중심과 주변의 분화에 따라 보충성을 국가-지방 관계에 헌법적 원리로 정식화한다. 보충성은 자연적 단위인 공동체의 통제 권력과 법적 책임을 인위적 단위인 국가의 그것보다 우선한다는 지방정치의 적극적인 분화 원리이다. 이런 맥락에서 보면, 중앙 집권에서 지방분권으로의 국가변형, 즉 국가우선에서 지방우선으로의 전환은 권력의 탈집중화와 결정의 탈중심화, 공중의 참여확대에 기반을 둔 지방정치의 분화에 달려있다. 그러나 중앙집권적 국가인 한국에서 지방분권 논의는 보충성을 권력의 중앙집중화에 따른 단점을 개선하기 위한 권력조종의 보조도구로 서만 해석한다. 그 결과 지방분권은 지방자치의 필요조건으로 다루어질 뿐 지방정치의 충분조건으로 인식되지 못하며, 보충성은 지방정치의 분화를 보장하는 원리로 인식되지 못한다. 지방정치가 미분화된 상태에서는 사실상 지방과 관련된 모든 결정권한이 국가에 있을 수밖에 없다. 따라서 중앙집권적 국가에 대항한 것은 지방정부가 아니라 지방분권운동이다. 그러나 지방분권운동이 과연 지방정치의 분화에 기여할 수 있을지는 불확실하다. 지방정치의 분화는 공중이 정치적 선거를 통해 지방에서 정권교체를 이루 어야 확인이 가능하다.

영어초록

World society is in the trend of state metamorphosis from centralization to decentralization. The differentiation of local politics presupposes decentralization, and decentralization aims not only to transfer authority from state to regions but to the emergence of regions free from state control. The European Union introduced Subsidiarity Principle in the alliance-member relations in the form of the Maastricht Treaty and the Lisbon Treaty. Western European countries formulate Subsidiarity in constitutional principle for state-region relations in order to successfully institutionalize decentralization. Subsidiarity is an active differentiation principle of local politics that the control authority and legal responsibility of the community, its natural unit, take precedence over the state of the artificial unit. In this context, state metamorphosis from centralization to decentralization, i.e. from state priority to region priority, depends on the differentiation of local politics based on innovative power steering between central and local governments and the expansion of public participation. The discussion of decentralization that presupposes a centralized state only interprets the subsidiarity principle as a complementary tool to the power steering to improve the disadvantages of the centralization of power. As a result, the decentralization in Korea is regarded as a necessary condition of local autonomy, but it is not recognized as a sufficient condition of local politics, and the subsidiarity is not recognized as a principle guaranteeing the differentiation of local politics. In the undifferentiated local politics, virtually all decision-making powers related to the region are in the state. It is the decentralization movement, not the local government, that is opposed to the state that centralizes power. However, it is uncertain whether the decentralization movement can contribute to the differentiation of local politics in the centralized state. The differentiation of local politics can be confirmed only when the public is able to change the regime through the political elections.
