지방분권과 지방자치, 지방 균형에 대한 헌법적 쟁점의 검토 (Constituitional Review of Pending issue on Korean Local Self- Government and Decentralization Policy)

초록

지방분권과 지방자치, 지방 균형이라는 이념은 이제 우리의 중앙집권적 국가전략이 더 이상 효과를 발효하지 못하는 상황에서 국가의 존립을 위해서 필수적인 요소라고 볼 수 있다 그런데 이제는 중앙정부중심의 정책으로 이를 해결하려는 것은 오히려 역효과가 발생할 수 있기에 신중을 기할 필요가 있다. 작은 정부론과 사회 및 지방정부의 자율성을 중시하는 방향으로 나가고 있는 현재의 흐름이 올바른 방향이라고 보인다. 중앙정부는 지방분권 이양시 이러한 개혁에서 자율과 그에 따른 책임을 반드시 지어야 한다는 원칙에 근거하여야 할 것이다.
즉 지방의 자율적 개혁을 유도하고 그로 인해서 중앙과 지방의 수평적 관계를 이루게 되고 국가는 이러한 과정에서 나오는 지역적 불균형을 해소하려는 방향으로 정책의 전환이 필요하다고 보인다. 그러기 위해서 지방의 재정자립도를 달성하고 그로 인하여 과거에 비해 지방정부의 자기책임을 더 물을 수 있게 함으로써, 지방정부가 독자적이고 적극적으로 수익적 사업과 외자유치를 할 수 있도록 하는 정책에 우선순위를 두어야 할 것이다. 지금까지의 중앙정부중심의 지방분권화니 지방 균형정책은 오히려 지방을 중앙 정책의 피동적인 실험장으로 만들어버릴 수 있다. 그나마 정책이 성공한다면 좋을 일이지만 자칫 실패한다면 우리 행정의 문제점인 탁상공론이나 중앙 정부적인 정책수립에 의한 정책적 과오로 진정으로 이룩하고자 하는 지방분권대신에 중앙집권이라는 정반대의 결과를 도출할 수 없게 된다. 특히 현재 헌법상의 지방자치는 제도라는 이름하에 너무 추상적으로 법조문을 중심으로 논의대신 우리 현실에 맞는 정책을 추진하여야 한다. 헌법이 현실에 국가정책에 기여하는 사회를 꿈꾸며 이제는 단지 정책사항이라는 이름하에 헌법판단을 회피하는 소극적 헌법학은 지양되기를 바란다.

영어초록

It is just that decentralization and local governance for election or a of a turnaround, as well as a temporary state of democracy, not in democracy countries are essential. Also Decentralization and local governance is a problem associated with efficiency of national competitiveness. And if that never the central government policy oriented to solve the basic direction is said may actually be a year. The central government has to transmigrate some part of their task which is local government can carry out, and instead of that, it seems reasonable to perform the legislature centered functions to supervisory or support for long-term. But the reform has to be based on the principle of autonomy and responsibility It seems that our government need to find a solution from not Korean Capital relocation policy but the decentralization policy which is a dividing force to succeed the reform and opening up of Chinese that inducing local decentralization to make a horizontal relationship between central government and local government, therefore government should make a policy selectively according to a region to solve the problem of regional disparity. In order to do that, government should leave a priority on the policy that reform a policy of dividing a tax system, which is a foundation of a dividing force, considering success of the Chinese local autonomous economic reforms, to achieve a local financial independence. Consequently it could be better to ask a responsibility of local government in order to induce local government to make an independent policy and actively to attract foreign capital with profitable business rather than just to give centra government financial help. The central government-led policy of relocation of capital or artificial policy can make a local government a passive testing ground of the central government-led policy. If the policy is unsuccessful, we should pay social costs which means political failure of central governmental policy making that is one of main problem of our armchair administration. Especially, present local self-government tends to be discussed abstractly under the name of system, and the success of the system could be imprinted as a failed trial without proper consideration. Now, it’s time to avoid passive constitutional judgement under the name of policies and I hope constitutional law study lead the government policy in the future.
