제주영리병원(녹지병원)과 지방분권 및 부패방지적 쟁점 (Jeju for-profit hospital (greenery hospital) and and decentralization and Anti-Corruption Issues)

초록

제주특별자치도지사는 제주특별법, 제주특별자치도 보건의료특례조례에 의하여 중국 녹지그룹의 외국법인에게 영리병원개설허가를 하였다. 제주특별자치도에 영리병원개설허가와 관련하여 주민의 반대와 공론화조사위원회의 반대에도 불구하고 제주특별자치도지사는 외국인전용이라는 조건을 붙여 개설허가를 하였으나, 녹지병원의 허가과정에서 국내병원 등의 우회투자 의혹, 녹지병원 모기업 대표 구속 등으로 인하여 부정부패의 논란이 가중되고 있다.
영리병원개설이 의료법에서는 금지하고 있으나 제주특별법에 의하여 지방자치단체장인 제주특별자치도지사에게 영리병원개설허가권을 부여하는 것은 지방분권이 강화된 것으로 여겨진다. 영리병원개설허가에 관련하여 지방분권강화에 따라 부정부패를 방지할 수 있는 법적문제와 그 개선 방안이 요구된다, 따라서 제주녹지병원과 관련하여 지방분권 및 부정부패 법제도와 현황을 살펴보고, 지방분권강화와 부패방지차원에서 제주녹지병원개설과 법치행정원리 구현, 보건의료심의위원회의 투명성 확보, 주민감사청구의 활성화, 도민감사관 및 감사위원회 등의 감사기관의 독립성과 감사의 실효성의 확보, 지방의회의 행정감사 청렴과 부패의 구별과 부패방지의무 신설, 지방공무원의 직권남용에 대한 형벌과 징계책임 강화, 부정부패자 명단공표에 관한 법적쟁점을 검토하여 그 개선방안을 제시한다.

영어초록

The Governor of Jeju Special Self-Governing Province has granted permission to establish a for-profit hospital for a foreign corporation of the Chinese Green Area Group under the Jeju Special Law and the Jeju Special Self-Governing Province Medical Special Regulations. In spite of the opposition from the residents and the opposition from the Public Opinion Investigation Commission, the Governor of Jeju Special Self-Governing Authority granted permission to establish a for-profit hospital in Jeju Special Self-Governing Province on the condition that it is exclusively for foreigners. In the process of permitting Greenery Hospital, discussions on damages have been exacerbated due to suspicion of investing in bypasses of hospitals in Japan and detention of the parent company of Greenery Hospital.
Although the establishment of a for-profit hospital is prohibited by medical services, granting the right to establish a for-profit hospital to the governor of the local government, Jeju Special Self-Governing Province, by the Jeju Special Law is considered to have strengthened decentralization. In connection with the permission to open a for-profit hospital, there is a need for legal issues and measures to prevent corruption based on strengthened decentralization.
Therefore, in view of the current status of the decentralization and corruption law system in connection with the Jeju Green Park Hospital, the establishment of the Jeju Green Park Hospital and the implementation of the principles of the law-government administration, the transparency of the medical council in the dimensions of strengthening decentralization and preventing corruption Security, validity of citizen's audit request, ensuring the independence and appreciation of auditors such as provincial auditors and audit committees, auditing of local councils, establishing distinctions between corruption and corruption, and establishing anti-corruption obligations. Examine the legal issues related to the punishment and disciplinary punishment of civil servants for abuse of authority and the public disclosure of the list of corrupt officials, and propose measures to improve them.
