초록

이 연구의 목적은 북핵 위협에 대해 추진되고 있는 선제공격의 제한성을 식별하고, 그 제한성을 해결하기 위한 방안을 제시하는 것이다. 즉 고도화된 북핵 위협에 대응하기 위해 한국군이 구상중인 선제공격에 대해 유엔헌장 내에서 정당화 할 수 있는 논리를 도출하고, 선제공격의 시점판단과 선제공격 시 확전방지 방안을 제시하고자 하는 것이다.
북핵 위협에 대한 선제공격은 북한의 지속적인 무력도발과 반복적인 정전협정 위반에 따라 유엔헌장 내에서 정당화 할 수 있으며, 선제공격의 시점은 핵과 미사일위협의 동향과 같은 군사적인 측면뿐만 아니라 외교ㆍ정보ㆍ경제측면을 포함하여 종합적으로 판단해야 함을 강조하였다. 마지막으로, 확전방지 방안은 선제공격 경고, 명확한 공격목표 설정 및 확전우세 태세 확립, 비살상무기체계를 병행하는 ‘선제공격 확전방지 구상’이 필요하다는 점을 제시하였다.
북한의 핵능력 고도화에 따라 선제공격의 실행 추진에 대해 향후 지속적으로 관심이 경주될 가능성이 높으나, 선제공격의 실행은 그리 간단하지 않은 것 또한 사실이다. 따라서 평소부터 치밀한 계획 수립과 관련 조직의 정비, 국제법에 근거한 관련 법령과 규정의 제정, 수행능력 확보, 특히 미국과의 공감대 형성 등 철저한 준비가 뒤따라야 할 것이다.

영어초록

The purpose of this research is to distinguish the limitations of a preemptive attack that has been pursued in relation to DPRK nuclear threat and present a plan for solving the limitations. Or, in other words, it is to draw a logic that can legitimate the preemptive attack that has been conceived by the Korean military in order to respond to DPRK threat, which has been accelerated, and to present the judgement on the time point of a preemptive attack and a plan for preventing a war escalation.
A preemptive attack regarding DPRK nuclear threat can be legitimated within the UN Charter because of the continued armed provocations and the repeated violations of the armistice agreement by DPRK. And, regarding the time point of the preemptive attack, it was emphasized that it must be comprehensively judged including not only the military aspects like the trends of the nuclear and missile threats but, also, the diplomatic, information, and economic aspects. Lastly, regarding a plan for preventing a war escalation, the point that a conception for the prevention of a war escalation after the preemptive attack that combines with the non-lethal weapons system is needed was presented in addition to the citations of the armistice rules of engagement of the UNC/CFC, which have been operated, and the others of the like.
According to the acceleration of the nuclear capabilities of DPRK, regarding the pursuit for the execution of a preemptive attack, the possibility is high that the interest will continue to strive in the future, it is, also, a fact that the execution of a preemptive attack is not at all a simple thing. As a result, the meticulous preparations must follow from the ordinary times, including the formulation of a careful plan, the consolidations of the related organizations, the enactments of the laws and regulations based on the international law, the securing of a performing capability, and, especially, the formation of a consensus with US, and others of the like.
