국가교육위원회와 교육부의 공법적 관계와 과제 (Public law relationship and assignment between the National Education Commission and the Ministry of Education)

초록

지난 2022년 9월 27일 「국가교육위원회 설치 및 운영에 관한 법률」에 근거하여 국가교육위원회가 출범하였다. 국가교육위원회는 정권이 바뀌어도 헌법상 교육의 기본원칙을 준수하고 교육정책의 안정성과 예측가능성을 제고할 수 있어야 한다. 국가교육위원회는 교육부의 교육정책결정권의 독점에서 벗어난 정치적 편향성이 배제된 장기적인 교육계획의 수립에 대한 국가과제를 안고 있기 때문이다. 특히 헌법과 교육 관련 법령에 따라 사회적 갈등의 골을 좁혀 사회적 합의를 도출하는 국가교육위원회의 기능과 역할을 요구한다. 국가주의적 교육행정체제는 교육제도와 운영이 획일적으로 경직되어 개별 교육의 주체 또는 이해 당사자의 자기결정권과 선택권을 침해할 수 있기 때문이다. 국가교육위원회와 교육부의 공법적 관계에서 헌법상 교육의 기본원칙인 자주성, 전문성, 정치적 중립성을 주요골간으로 교육정책에 대한 과제를 도출하는 것이 본고의 목적이다. 따라서 헌법상 교육이념과 교육의 기본원칙에 입각하여 국민의 교육권이 보다 효과적으로 발현될 수 있도록 국가교육위원회와 교육부의 헌법적 역할과 의무를 공법적 관계와 과제를 중심으로 논의하고자 한다.

영어초록

On September 27, 2022, the National Education Commission was launched according to the Act on the Establishment and Operation of the National Education Commission. So far, the legitimacy of the establishment of the National Education Commission and the legal status and organization of the National Education Commission have been discussed as the main framework. Even if the government changes, the National Education Commission must respect the basic principles of education under the Constitution and enhance the stability and predictability of education policies. The National Board of Education has the assignment of establishing a long-term education plan that is free of political bias and free from the monopoly of the education policy decision-making authority of the Ministry of Education. The National Education Commission must draw social consensus by narrowing social conflicts in accordance with the Constitution and education-related laws. This is because the nationalistic educational administration system is uniformly rigid in its education system and operation, which can infringe on the self-determination and choice of individual education subjects or interested parties. The purpose of this thesis is to derive assignments for education policy based on independence, professionalism, and political neutrality, which are the basic principles of education under the Constitution, in the public law relationship between the National Board of Education and the Ministry of Education. Therefore, based on the constitutional educational ideology and basic principles of education, it is necessary to effectively guarantee the people's right to receive education. Under the premise that the National Board of Education and the Ministry of Education are obliged to fulfill their constitutional roles, we would like to discuss the required public law assignments.
