수사절차상 체포적부심사제도에 관한 연구 (A Study on the Judicial Review of the Legality of Arrest in Investigation Procedures)

초록

체포는 강제수사로서 수사기관이 피의자를 최대 48시간까지 수사관서에 구금할 수 있다. 우리 헌법과 형사소송법은 수사기관의 불법체포를 통제하기 위한 장치로서 체포적부심사제도를 규정하고 있다. 본 연구에서는 체포적부심사제도의 운영 현황과 쟁점을 살펴보고 개선방안을 제시하였다. 먼저, 피의자의 체포적부심사청구권을 실질적으로 보장하기 위해서는 체포적부심사청구권의 고지를 형사소송법에서 명확하게 규정할 필요가 있다. 또한 체포적부심사 청구시 심리가 신속하게 이루어지도록 법제도를 정비할 필요가 있다. 다음으로 현행범체포, 긴급체포 등 체포 현황에 대한 정보가 공개되어야 한다. 체포의 적법성을 강화하기 위해서는 체포 후 유치장에 구금되는 피의자에 대해서는 체포적부심사 절차를 의무화하는 방안을 고려할 필요가 있다. 또한 경찰의 내부적인 불법체포에 대한 통제방안으로 영국에서 시행되고 있는 구금담당관 제도를 참고할 필요가 있다.

영어초록

Arrest in criminal proceedings is an important forced investigation to secure the suspect's whereabouts from the perspective of an investigative agency and reveal criminal charges. Arrests, however, not only directly restrict the suspect's physical freedom and defense rights, but can also be held at investigative offices for up to 48 hours. The Korean Constitution and the Criminal Procedure Act have various regulations as a means of controlling illegal arrest of investigative agencies. As a representative regulation, the arrest appropriate examination system is the right of the suspect to examine the illegal arrest of the investigative agency, which is meaningful as a system to control the illegality of the investigative agency and protect the human rights of the suspect. But the legal examination for arrests that is much more than arrest is very low in practice. In order to secure the legality of the investigative arrest, the arrest adjudicator system to be substantially activated, it is necessary to more clearly define the notification of the right to request an arrest adjudicator in the Criminal Procedure Act and to reorganize the legal system so that the hearing is carried out quickly. In addition, statistics on the status of the arrest must be prepared and disclosed. In fact, appropriate arrest and constitutional complaints are not recognized for suspects released after arrest. In order to strengthen the legality of the arrest, it is necessary to consider making it mandatory for suspects who are detained in detention after arrest. As a measure, it is necessary to refer to the Custody Officer system implemented in the UK as one of the measures to control the police's internal illegal arrest and detention.
