교육부장관 인사청문회의 효과성 연구 (A Study on Effectiveness of Confirmation Hearing for the Secretary of Education)

초록

본 연구의 목적은 대통령의 후보자 지명 과정, 후보자와 청문위원 측의 청문회 준비 및 실제 공방 과정을 분석함으로써 교육부 장관 인사청문회의 효과성을 검토하는 데에 있다. 구체적인 연구 문제는 다음과 같다. 첫째, 대통령은 교육부 장관 후보자를 효과적으로 지명하고 있는가? 둘째, 후보자와 청문위원들은 인사청문회를 효과적으로 준비하고 있는가? 셋째, 후보자와 청문위원들은 인사청문회를 효과적으로 진행하고 있는가? 넷째, 인사청문회는 효과적으로 종결되고 있는가? 분석 결과, 첫째, 대통령의 교육부 장관 후보자 지명 단계에서는 대통령의 후보자에 대한 부실한 사전 검증, 청문회 통과 가능성만을 염두에 둔 후보자 인선 등으로 목표 달성도와 효율성 측면에서 문제가 되고 있었다. 둘째, 청문회 준비 단계에서 후보자는 교육부 고위 공무원들의 청문회 통과 지상주의 및 이로 인한 후보자의 소극적 답변 태도 등으로 인해 목표 달성도와 효율성 측면에서 본래의 목적 달성에 지장을 받고 있었다. 또, 청문위원들의 여방야공적 태도, 후보자에 대한 고압적 입장과 수직적 관계 인식, 강한 이념 지향성, 정치적 의도 과잉 등으로 인해 인사청문회의 목표달성도·효율성·공정성·만족도를 떨어뜨리고 있었다. 넷째, 청문회 종결 단계에서는 인준 투표 규정의 미비, 인사청문경과보고서 채택 기준 모호, 청문회 결과와 상관없이 대통령의 후보자 임명 가능 등의 문제가 인사청문회의 목표달성도와 공정성을 위협하고 있었다.

영어초록

This study aimed to examine effectiveness of the current confirmation hearing for the Secretary of Education by analyzing the hearing process for the Secretary of Education by the nominees and hearing committee members.
The research questions are as follows; (1) Does the president effectively nominate candidates for the Secretary of Education? (2) Are candidates and the committee members effectively preparing for confirmation hearings? (3) Are candidates and the committee members effectively conducting personnel hearings? (4) Is the personnel hearing effectively concluded? The results of the study were as follows. First, the orignal purpose and efficiency of hearings was harmed because the nomination process could cause the President to nominate a nominees just based on the moral character and possibility of passing the hearings.
Second, the orignal purpose and efficiency of hearings was harmed from being achieved because of high-ranked officials’s attitude just to complete the hearings without any difficulties and nominees’passively responding to questions.
Third, the committee members used the hearings as a place to play bipartisan competition. In addition, the purpose, the efficiency, impartiality, and satisfaction seemed to be damaged due to committee members’overbearing attitudes towards the nominees, and hierarchical attitudes towards the nominees, strong bias towards one’s affiliated ideology, lack of opportunities given to the nominees to answer, and excessive expression of political intention.
Firth, different from the United States, the hearing report can be accepted without vote on the ratification of the hearing, and the President can appoint the nominee as the Secretary regardless of the result of hearing. These aspects of hearing process in Korea can threaten its purpose and impartiality.
