초록

부통령제도는 제2공화국에서부터 우리 헌법상 사라진 제도이지만, 개헌과 관련하여 부통령제도를 다시 도입하여야 한다는 주장이 제기되고 있다. 이러한 부통령제도를 바람직하게 설계하기 위하여는, 우리 건국헌법상의 부통령제 도입에 관해 살펴보고 이로부터 통찰을 얻어 앞으로 나아갈 방향을 생각해보는 작업이 필요하다. 본 글에서는 먼저 건국헌법상의 헌법 조문들을 토대로 건국헌법상 부통령의 지위와 역할을 살펴보고, 이어서 부통령제에 대한 제헌국회 본회의에서의 논의를 살펴본다. 그리고 이를 통하여 건국헌법상의 부통령제는 정치세력 간의 권력 배분 목적의 헌법 설계, 부통령제는 으레 있어야 하는 것으로 받아들인 당시의 인식, 종래의 도식적 정부형태론에 입각한 제도 구상 등의 원인으로 인하여 별다른 의미 없이 도입된 것이라는 결론을 내린다. 그 후 이러한 비판적 인식에 입각하여, 앞으로의 부통령제 도입 논의가 구체적인 도입 필요성에 입각한 논의, 부통령에의 실질적인 권한과 역할의 부여, 정부형태 이론 및 기존 제도와의 체계정합성 추구 쪽으로 방향이 설정되어야 함을 제안한다.

영어초록

The vice-presidential system has disappeared from the Second Republic in our constitution, but in the discussion of the constitutional amendment, it is argued that the vice-presidential system should be reintroduced. To properly design such a system, it is necessary to examine the introduction of the vice-presidential system in our founding constitution and to think about the direction to proceed based on it. This article first examines the constitutional status and role of the vice president in Korea’s founding constitution based on the constitutional texts of the constitution, and then examines the discussions of the vice-presidential system that were made at the constitutional assembly plenary sessions. After that, it is concluded that the introduction of the vice-presidential system in the founding constitution was not the product of well-considered constitutional discussion and was not the proper system, and that its introduction was the product of causes such as the purpose for the constitutional allocation of power among the political forces, the acceptance of the existing practices of designing the constitutional system without thorough review, and its institutionalization based on the somewhat blind following of existing theories of the forms of government. Finally, this article suggests that in the future, the debate on the introduction of the vice-presidential system to the constitution should be focused on the concrete necessity of the introduction, the substantial authority and role that should be granted to the vice president, and constitutional coordination.
