조선초기의 순군만호부(巡軍萬戶府)의 조직과 기능에 관한 연구 (Study on The Police Organization and Function of Soongunmanhobu during The Early Chosun Dynasty)

초록

순군만호부는 원(元)의 지배 하에 있었던 고려말 충렬왕대에 元의 제도를 모방하여 수도 개경의 내외를 순찰하며 수도의 치안을 유지하기 위하여 설치된 순라군(巡邏軍) 즉 경찰부대였다. 그러나 점차 발전함에 따라 그 설치목적이 변질되어갔고 명칭도 순군만호부(巡軍萬戶府)로 개칭되면서 그 맡은 바 업무와 권한도 무한대에 이르렀다. 이러한 순군만호부가 고려말에 몇 번의 명칭변경 등의 과정을 거치면서 조선왕조 성립에 주역으로 등장하였다. 조선왕조 초기 순군만호부는 순위부→의용순금사→의금부로 개칭되는 과정에서 경찰상층부 구조와 하부구조체제가 완전히 이루어져 원시적이나마 오늘날과 같이 근사(近似)한 경찰체제를 갖춘 최초의 경찰기구였다는 점에서 경찰사적 측면에서 중요한 의미를 지니고 있다고 보아야 한다. 이런 점에서 볼 때 순군만호부의 조직과 기능은 일반적으로 과소평가되는 측면이 강한 반면 오히려 조선 후기의 포도청에 관한 조직과 기능적 측면이 과대포장된 면이 적지 않다는 점을 지적하고 싶다. 순군만호부는 순작(巡綽)과 순위(巡衛:왕실시위근무), 포도금란(捕盜禁亂:도적을 잡고 폭행이나 반역음모 방지), 국왕의 사적 도구로의 이용, 권력과 밀착된 권한 남용, 고문 등 무소불위의 권한과 업무범위로 인하여 공포와 두려움의 대상이 되기도 하였다. 따라서 순군만호부에 대한 축소과정과 역사적으로 소멸되는 결과는 순군만호부 자체가 그 원인을 제공했다고 보아야 한다.
그 결과 국왕과 타 기관의 견제 등으로 인하여 수십년동안 독자적인 경찰기관은 존재치 않고 순찰활동은 군부(軍部)에서, 그리고 포도금란의 임무는 사헌부, 형조, 승정원 등 타 기관의 해당관련 업무로 분산. 이관되는 비운을 겪게 된다. 이처럼 순군만호부는 후일 포도청 성립에도 일정부분 영향을 미쳤다고 볼 수 있다. 따라서 도적이 성행할 때는 임시로 포도부대(捕盜部隊)를 조직하여 운영하다가 평온해지면 없애고 하는 행태를 되풀이 하다가 포도청의 성립연대조차 아직도 정확히 구명(究明)치 못하는 결과를 가져왔다고 보인다. 따라서 본 연구는 순군만호부가 한국경찰사에서 차지하고 있는 그 역사적 의미와 교훈은 무엇인가에 대하여 고찰해보고 그 공(功)과 과오를 되짚어보는 계기의 장을 마련하고자 함을 궁극적인 목적으로 하였다.

영어초록

Soon-Gun-Man-Ho-bu, the police force was established in the late Korea dynasty by King Choongryel in order to keep the safety of the capital city. The organization imitated the police system of Chinese Yuan dynasty, because the Korea dynasty was under the influence of the Chinese Yuan dynasty at that time. The organization undergone a variety of transitions with its progress. As a result of these transitions, the police force obtained the infinite missions and power, after its name had been changed from Soonragun to Soongunmanhobu. The name of the organization was repeatedly changed to Soonwiibu and Euiyongsoongumbu. Lastly, the police force was renamed Euigumbu. The organization conducted a leading role to establish the Chosun dynasty through these changes of the name in the late Korea dynasty. It has important meaning in the Korean police history, because Soongunmanhobu is the first police organization which is similarly designed to the present police force. It entirely comprised the superstructure and the substructure, although it was a primitive state. In this context, I would like to point out the fact that the function and organization of Soongunmanhobu has been commonly underestimated. On the other hand, it has been believed that the function and organization of Podochung established in the late Chosun dynasty is rather overestimated. It is true that Soongunmanhobu became the fearful and horrible authority, since it wielded absolute power and conducted various police activities such as protecting royal family, arresting criminal, preventing military coup, handling king's private order and putting to torture. As a result of these abuses of its power, the Soongunmanhobu experienced the reduction of authority and finally disappeared in the Korean history. It must be true that Soongunmanhobu lost its power due to its misconduct. There had been no police organizations for several decades, after Soongunmanhobu slipped away. It is because kings and other law enforcements checked the emergence of similar police organization. The area patrols were conducted by military force and the duty arresting criminals was performed by other law enforcements such as Sahunbu, Heongjo and Sungjeongwon during the time. It is one of star-crossed events of Korean police history. Nevertheless, It is assumed that Soongunmanhobu partially influenced the establishment of Podochung in the future. It seems that the chosun dynasty temporarily organized and operated the police force, Podobudae, to arrest thiefs while larceny cases were increasing. But the police force was immediately deactivated, when the security condition returned to the normal situation. These appearance and disappearance of the police force were repeated. That is why we don't recognize when Podochung was exactly established. In conclusion, the purpose of this study is not only to contemplate the historical meaning and lesson of Soongunmanhobu in the Korean police history, but also to look back on the merits and demerits of Soongunmanhobu.
