인격주의 생명윤리 관점으로 본 ‘자기결정’에 대한 고찰 (A Study on the Self-Determination in the Perspective of Personalism Bioethics)

초록

최근 한국 사회에서 생명윤리 관련법들이 입법되고 있다. 이들 법안은 인간의 존엄과 자기결정권의 보호라는 윤리적인 개념을 포함하고 있는데 이 둘은 생명윤리의 상황마다 그 의미의 폭에 따라 충돌하고 다양하게 해석된다. 인간이 자신의 신체와 생명에 대한 권리를 갖는다는 자기결정권은, 그 목적인 인간 존엄성을 보장하기보다 자신의 생명에 대한 권리만 주장하며 타인의 생명권을 경시하는 경향을 나타내기도 한다. 자기결정권은 어느 순간 모든 것을 결정할 수 있기 때문에 생명을 다루는 문제에서는 신중해야 하는 주제이다. 따라서 앞으로 인간의 삶을 결정할 수 있는 권한이라는 의미로서 자기결정권을 숙고할 필요가 있다.
현대 사회에서 자기결정권은 자율성에 의미를 두고 있으며, 의료현장에서 안락사나 낙태의 경우에 적용된다. 이 권리에 의해 판결 내린 사례도 있으나 그리 많지는 않다.
법 안에서 자기결정권의 개념은 지극히 주관적이고 개인적인 권리로 인식한다는 공통점이 있으나, 유사한 용어가 사용되어 각각의 차이를 구분할 필요가 있다. 또한 자기결정권이 현대의 의미를 가지게 된 배경을 칸트, 이사야 벌린의 주장을 통해 더욱 명백하게 드러내 보일 수 있다. 이러한 근거에도 불구하고, 이성으로만 판단이 가능하고 제한적으로 적용되며, 책임에 대해 언급하지 않는 것을 한계점으로 들 수 있다.
이 문제를 토마스 아퀴나스, 에머리히 코레트를 통해 인격주의 생명윤리 관점으로 해소하려고 한다. 이를 통해 극 이성주의, 조건주의 인간관에서 벗어나서 자유가 방종이 아니라 책임이 부여되어야하고, 인간이 실존자체가 인격적 지위가 있음을 밝히고 있다.
인간은 생명권이라는 소중한 권리를 가지며, 그 자체만으로도 생명의 가치를 가진다. 인간이 무언가 선택을 할 때는 선을 지향하고 그 안에 자유와 책임의 원칙이 있음을 상기해야 한다. 이러한 견지에서 또한 의사는 환자가 올바른 판단을 내릴 수 있도록 협조해야하고 입법기관에서는 법 안에 생명과 이익이라는 모순적인 결합을 하지 않아야 할 것이다.

영어초록

Acts on bioethics and life have recently been enacted in Korea. ‘Bioethics and Safety Act’(2004) and so-called ‘Hospice, Palliative Care and Life-sustaining Treatment Decision-making Acy’(2016) are good examples. They contain ethical concepts of both human dignity and protection of the right to bodily integrity. The two concepts collide with each other and have various interpretations under the different bioethical situations, depending on the range of their interpretations. The right to bodily integrity, which means that human person has the right over its body and its life, may tend to ignore that of other people while claiming only its own right to life, rather than ensuring human integrity that is supposed to be the goal. The right to bodily integrity should be seriously considered when issues on life are addressed, for one can exercise this right to decide everything within a moment. As such, what needs to be contemplated is the aspect of the right to bodily integrity that has authority to determine human life. In the modern society, the right to bodily integrity is based on autonomy, and is applied to euthanasia or abortion in the medical field. There have been verdicts delivered based on this right, however the number of such verdicts are not many.
Commonly, concepts on the right to bodily integrity in laws are extremely subjective and this right is recognized as a personal right. However, similar terms are used for it, and distinguishing the terms from each other is required.
The opinions from Kant, Mill, Hume as well as Isaiah Berlin can more clearly reveal how the right to bodily integrity came to have its modern meanings. However, despite the referenced opinions, there are limitations in that the concepts can be assessed only based on reason, limitedly applied, and don’t mention responsibility at all.
This paper intends to overcome the limitations by taking personalist bioethical approaches with research on Thomas Aquinas, Emerich Coreth, and Max Scheler. By doing so, it stipulates that freedom should come with responsibility, not with self-indulgence. Also it states that people are endowed with the status of human beings simply because of their existence per se, freeing from extreme rationalism and conditional view on humans.
All the humans have the right to life, which is a valuable right, and deserve to live as they are. When humans make a choice, they should try to reach toward goodness while being reminded that the principle of freedom and responsibility is applied to their choice. In this vein, for its part, a doctor should cooperate with patients so that they can make a wise and informed decision whereas legal institutions should put life ahead of interests in laws, an essential value, and interests in a way that the two concepts are conflicting within laws. The right to bodily integrity should be carefully considered in issues associated with life since the right can decide everything at a specific moment. Accordingly, the right to bodily integrity needs to be contemplated in a sense that the right has authority to determine human life.
