헌법학적 관점에서 본 대학의 자치와 한계 (The Autonomy and Limitation of University From a Constitutional Viewpoint)

초록

대학의 학문연구와 교육을 담당하는 기관이다. 학문연구와 교육을 지배하는 원리는 고독과 자유이다. 이러한 지배원리를 제도적으로 구체화한 것이 헌법상 대학의 자치이다. 시대가 변화하면서 대학의 자치의 주체는 아직도 우월적인 지위를 차지하고 있는 교수뿐만 아니라 대학의 구성원에게 참여와 결정권을 부여하였다. 최근에는 대학은 입학자원의 감소, 국가의 대학 평가제도, 재정적인 부분을 국고에 의존하는 정도가 커지면서 자치권이 약화되고 있다. 대학의 자치권도 헌법상의 권리이고 자유권적 성격과 사회권적 성격도 가지고 있다. 대학의 자치가 자유권적 성격을 가지고 있다고 보면 국가는 대학의 자치에 개입을 최소화하여 대학이 가지고 있는 고유한 기능인 학문연구와 교육의 기능에 충실히 하도록 지원을 해야 한다. 본 논문에서는 대학 자치의 기본적인 개념과 내용을 중심으로 대학의 자치의 헌법상 한계에 대하여 논의하고자 한다.

영어초록

University is an institution that is in charge of a scholastic research and education. The principle of controlling the academic research and education includes loneliness and freedom. What institutionally specified this dominant principle is the constitutional university autonomy. The autonomy of university in the past was formed centering on the faculty council. With a change in the times, the main agent of the university autonomy granted a right of participation and decision to university members as well as to professors who are still taking up the superior status. The university is being recently weakened an autonomous right due to a reduction in the admission resources, to the nation's university assessment system, and to the bigger level of financial section in relying upon the government subsidies. Especially, a few universities with a low fiscal self-reliance ratio are in the real situation that the university autonomy, which is guaranteed constitutionally, is being controlled and intervened by the nation. The university autonomy is also a constitutional right and has the character based on a right of freedom and the character based on a social right as well. Considering that the university autonomy has the character based on a right of freedom, the country needs to minimize the intervention in the university autonomy, thereby necessarily giving a support in order to be loyal to the function of the academic research and education, which correspond to the unique function that the university has. This study aims to discuss about the constitutional limitation of the university autonomy focusing on a basic concept and contents of the university autonomy.
