무력충돌시 동물의 보호에 관한 일고찰 (A Review on the Protection of Animals in Times of Armed Conflict)

초록

무력충돌은 인간이 만들어 낸 최악의 작품이다. 무력충돌이 인간, 환경 및 생태계에 미치는 악영향은 막대한 것이며, 국제사회는 무력충돌을 억제하기 위하여 부단한 노력을 경주해왔다. 무력충돌에서 인간은 승리자가 될 수 있으며, 또한 패배자도 될 수 있다. 그러나, 인간과 달리 환경 및 생태계는 무력충돌에 있어서 언제나 희생물이며, 무엇보다도 동물은 무력충돌에 있어서 참혹한 운명에 직면하게 된다.
무력충돌법의 역사는 국제법의 역사와 함께 시작되었다. 전쟁의 참혹함은 양차 세계대전을 통해 국제사회의 양심에 각인되었고, 이러한 양심의 파괴를 방지하고자 하는 국제사회의 노력은 무력충돌법에 반영되었다. 무력충돌법에서 인간은 전투원 및 민간인으로서 각각의 지위에 따른 권리를 행사하고 의무를 부담한다. 그러나 망각하지 말아야 할 것은 무력충돌에 인간만이 관련되는 것이 아니라는 점이다.
역사적으로 동물은 전쟁에서 끔직한 피해를 입었으며, 자신의 의사와 무관하게 무력충돌에 동원되었다. 특정 군사작전을 위해 동물은 희생되었고, 무력충돌의 상황에서 밀렵, 밀매 및 약탈의 대상이 된다. 무력충돌에 대한 동물의 실질적 관여에도 불구하고, 무력충돌법은 무력충돌시 동물의 보호에 대하여 사실상 침묵하고 있다.
물론, 무력충돌법상 민간인의 보호와 관련된 규정을 동물에 적용함으로써 무력충돌시에 동물은 보호될 수 있다. 그러나, 군사적 필요성에서 동물의 보호는 여전히 제한적인 것이다. 이러한 맥락에서 동물의 보호 및 동물이 향유할 수 있는 권리를 직접적으로 규율하는 무력충돌법의 제정 필요성이 제기되고 있다. 그러나, 무력충돌시 동물의 보호를 직접 규정하는 무력충돌법의 제정은 현실적으로 어려울 것으로 생각되는데, 왜냐하면 무력충돌법은 인간 중심적 관점 및 인류세의 관점에 기반을 두고 있기 때문이다. 인간 중심적 관점의 극복이 병행되지 않는다면, 무력충돌시 동물은 매우 제한적으로만 보호될 것이다. 무력충돌법상 동물이 인간 또는 물자가 아닌 독립적인 주체로서 간주되지 않는다면, 무력충돌시에 동물에 대한 적절한 보호는 기대하기 어려울 것이다.

영어초록

Armed conflict is the worst creation of man. The adverse effects of armed conflict on humans, the environment and ecosystems are enormous, and the international community has made unstinting efforts to prevent armed conflict. In armed conflict, humans can be both victors and losers. However, unlike humans, the environment and ecosystem are always victims in armed conflict, and above all, animals face a terrible fate in armed conflict.
The history of the law of armed conflict began with the history of international law. The horrors of war were imprinted on the conscience of the international community through the two world wars, and the international community's efforts to prevent the destruction of this conscience were reflected in the law of armed conflict. In the law of armed conflict, humans enjoys the rights and bear the responsibilities according to their respective status as combatants and civilians. However, it should not be forgotten that humans are not the only ones involved in armed conflict.
Historically, animals have suffered horribly in armed conflict and have been frequently mobilized in armed conflict against their will. Animals are sacrificed for certain military operations and are subject to poaching, trafficking and looting in situations of armed conflict. Despite the substantive involvement of animals in armed conflict, the law of armed conflict is virtually silent about the protection of animals in armed conflict.
Animals can be protected in times of armed conflict by applying the provisions related to the protection of civilians and civilian objects under the law of armed conflict to animals. However, under the military necessity, the protection of animals is still limited. In this context, the necessity of making an law of armed conflict that directly regulates the protection of animals and the rights they can enjoy is being suggested.
However, it is considered difficult to make an armed conflict law that directly regulates the protection of animals during armed conflict, because the law is based on a people-centric perspective and the anthropocene perspective. Without the overcoming of an anthropocentric view, animals will only be protected to a very limited extent during armed conflict. If animals are not regarded as an separate category rather than humans or objects under the law of armed conflict, it will be difficult to expect adequate protection for animals during armed conflict.
