해양레짐의 관점에서 본 PSI의 실행 과제 (A Review on the Implementation Topics of PSI from the Perspective of Ocean Regime)

초록

우리 정부의 PSI의 정식참여에 따라 국제사회 일부의 PSI에 대한 비판적 시각을 극복하고 한반도의 특수한 안보환경과 긴장된 남북관계 속에서 PSI의 실행이 현실적 문제로 대두된다. 한반도 주변수역에서 PSI의 실행은 기국의 법 개체인 선박의 특수성과 함께 한반도의 군사적 긴장, 동북아에서 해양문제를 둘러싼 갈등과 복잡한 국제적 역학관계를 고려하면 한층 복잡하고 어려운 문제가 예상된다.
PSI는 출범 후 대량살상무기의 확산 차단노력을 위한 국제사회의 협력을 이끌어내고 확산방지에 기여했다는 긍정적인 평가에도 불구하고, PSI의 국제법적 정당성이 약하고 차단(interdiction)을 위한 행동방안들이 기존의 국제법 질서, 특히 유엔해양법협약상의 해양레짐과의 관계에서 비판을 받아왔다. 이런 점 때문에 PSI 차단원칙은 차단의 실행에서 국내법 및 국제법과 유엔안보리를 포함한 국제법 틀(framework)과의 합치성을 강조하고 있으며, ‘WMD 차단목적 달성을 위한 국내 및 국제법 기반 강화’ 가 PSI의 중요한 원칙이 되고 있다.
PSI는 새로운 국제법적 기반을 창출하지 않고 현행 조약·협약이나 수출통제 레짐 안에서 이루어지고 있다. PSI의 국제법적 정당성의 문제는 무엇보다도 PSI가 WMD 확산 방지를 위한 국제사회의 자발적인 동참을 유도하면서도 ‘UN의 틀’ 을 벗어나서 한정된 국가의 참여로 실행되고 있다는 점에 있다. 이러한 배경에서 본 논문은 PSI에 대한 전체적인 이해와 함께 실행과정에서 제기될 수 있는 문제점을 중심으로 PSI 실행의 과제와 고려사항을 분석한다.

영어초록

A heated maritime security issue on the Korean Peninsula concerns the Proliferation Security Initiative (PSI), a U.S.led global effort that aims to stop trafficking of weapons of mass destruction (WMD), their delivery systems, and related materials to and from states and non-state actors of proliferation concern.
The South Korean government decided to fully participate in the PSI in the wake of a nuclear test by North Korea, on May 25, 2009. However, South Korea confirmed that the Agreement on Maritime Transportation between the South and the North would remain valid.
The South Korean government had wavered on fully joining the PSI given the volatile and unique security situation on the Korean Peninsula. The South Korean government stuck to its position that while it supported the PSI, it would not join on the grounds that full participation might provoke a military conflict with North Korea and that joining the PSI did not match with South Korea's engagement policy toward the North. Most importantly, the South Korean government referred to the Agreement of Maritime Transportbetween the South and the North noting that the Agreement would bring the same effects as joining the PSI.
Whether thePSI is consistent with ocean regimes under the UN Convention on the Law of the Sea is a moot point. Despite the PSI has contributed to preventing the spread of weapons of mass destruction (WMD), some criticism has been raised with respect to the legality and legitimacy of the PSI. The criticism is primarily focused on the point that the PSI, a global effort involving the use of forces to prevent the illicit trafficking of WMD, was formulated outside the UN framework. Of particular concern in terms of the implementation of the PSI at sea in this regard concerns how to make it consistent with fundamental regimes under international law such as innocent passage and freedom of navigation in the high sea and the rights of flag state.
