무력충돌시의 환경보호에 관한 연구 (A Study on Environmental Protection in Armed Conflict)

초록

최근 들어 지구규모의 환경오염이 심각해지고 인간생존을 위협하는 문제가 야기되면서 환경문제는 국제사회에서 중대한 문제로 인식되기 시작하였다. 환경오염은 그 특성상 개별 국가의 노력만으로는 해결할 수 없다. 그렇기 때문에 국제사회의 긴밀한 협조와 노력이 요구된다. 국제사회는 지금까지 수많은 환경관련 조약을 체결하고 UN 또는 UNEP(United Nations Envi- ronment Program: 국제연합 환경계획)을 비롯한 국제기구의 결의나 행위준칙 등 많은 환경관련 법규를 제정하는 등 구체적인 노력을 해 왔다.
한편, 전통국제법 하에서는 무력분쟁이 국가안전보장과 밀접한 관련이 있는 경우에는 환경보호보다는 국가안전보장이 우선시 되어왔다. 과거의 분쟁사례를 살펴보면 무력분쟁시 환경보호는 있을 수도 없고 오히려 환경을 이용해 무기로 삼는 경우도 있었다.
또한 1991년 걸프전에서는 유정방화로 인해 해양오염은 물론 수개월간 검은 연기가 상공을 덮고 있을 정도로 대기 오염 또한 심각하였다. 앞서 언급한 바와 같이 오염의 월경적 본질 때문에 일국의 대기오염이나 해양오염은 쉽게 주변 국가들의 환경에 영향을 준다. 따라서 국제공동체는 심지어 무력충돌시 발생한 오염을 포함한 오염을 방지하고 통제할 수 있는 효과적인 체제를 마련하여야 한다.
본 논문에서는 먼저 국가안전보장과 환경보호의 관계를 살펴보고 무력분쟁시의 환경보호에 대한 국제법제도와 무력분쟁으로 인해 발생한 환경파괴에 관한 사례를 살펴보았다.

영어초록

Recently, international community recognized environmental problems as international concerns, because of growing rate of trans-boundary pollution and its seriousness to be enough to threat to human life. Without collaboration with neighboring states, it is extremely difficult or impossible to control and recover environmental harms due to the trans-boundary nature of pollution. Therefore, it is possible to say that the close collaboration of actors in international community is necessary to control the pollution and to recover its environmental harm. To protect environment from pollution, states have taken concrete actions by ratifying various conventions on environmental protection, adopting various resolutions at the United Nations or the United Nations Environment Program, and enacting domestic laws on this issue.
Nevertheless, from the viewpoint of traditional approach to international law, the national security has been preferred to the environmental value, especially when the armed conflict in question is closely related to the national security. In some of precedents, states even considered that the environmental value might be utilized as military strategy. During Gulf war in 1991, intentional incendiary actions to oil wells and destruction of oil refineries brought serious air and maritime pollution for several months. As mentioned as above, air or maritime pollution in one state easily influence to the environment of the neighboring states due to the trans-boundary nature of pollution. Therefore, international community should prepare effective mechanism to prevent and control pollution even happened in armed conflict.
In this context, this article deals environmental protection in armed conflict by referring (1) the relationship between the national security and the environmental protection, (2) the precedents of environmental harms happened in armed conflicts, and (3) lex lata and lex feranda on this issue.
