신탁법의 관점에서 본 공공신탁법리 (The Public Trust Doctrine and Korean Trust Law: A Viable Tool for Environmental Protection?)

초록

최근 환경법 분야에서 미국의 공공신탁법리를 우리나라에 도입하여야 한다는 논의가 이루어지고 있다. 미국의 공공신탁법리를 도입하면 법령의 도움 없이도 환경파괴행위를 금지할 수 있고, 원고적격을 확대할 수 있으며 환경파괴를 야기할 수 있는 정부의 행위에 대한 책임을 보다 엄격히 물을 수 있다는 것이 그 요지이다. 그러나 미국의 공공신탁법리는 전통적으로 항행가능한 유수에 대한 일반 공중의 자유로운 이용을 보장하기 위해 발전한 것으로, 자연환경 보전을 위한 법리로서 이용되는 예는 제한적이다. 또 원고적격 등에 관한 논의에서 보는 것처럼 공공신탁법리가 신탁법리의 연장으로서 이해될 수 있는가에 관해서도 상당한 논란이 있다. 우리나라에 도입이 주장되는 공공신탁이론은 자연환경의 보전을 위해 그 도입이 필요하다는 것이다. 그러 신탁제도는 근본적으로 신탁재산의 보전을 목적으로 하는 것이지만 환경문제는 보전인가 이용인가에 관한 선택의 문제이다. 또 환경문제에 대해서는 공법적 규제로서 대응하는 것이 보다 타당하고, 사인간의 이해관계 조절을 위한 사법의 법리를 끌어들이는 데에는 신중할 필요가 있다. 그러므로 신탁법리를 환경문제에 대응하기 위한 수단으로 이용하는 것은 적절하지 않다.

영어초록

There are certain scholars in Korea, who claim to introduce the American Public Trust Doctrine into the Korean legal scheme. However, they do not explain what kind of “trust” is the Public Trust, how that “trust” come into existence, on what ground the members of the public can sue the government. In this article, the author tries to understand the Public Trust Doctrine in terms of the American, and Korean trust law.
American Public Trust Doctrine is a judge-made law by several cases in the 19th century. It says that the state holds certain resources in trust for the public and that the state owes the fiduciary obligations to the public. The doctrine was used mainly for the protection of the public’s use of the navigable waters. Following the seminal article by Professor Joseph L. Sax, some court expanded its scope of application. Despite its doctrinal and theoretical limitations, environmental scholars and activists keep using it to advance their agenda.
Korean scholars who support the doctrine argue that certain resources are so important that they are entrusted to the government which serves as the trustee for the public. Accordin to Korean trust law, the trust is void if the settlor, trustee and beneficiary is the same entity. If the public is the settlor in the doctrine, we cannot have a legally enforceable trust, because the public is the beneficiary, and the trustee as well throught the representation.
Korean legal doctrine of property also needs to be addressed. Due to the civil law tradition, exclusivity is a part of the ownership in Korean property law. Therefore there can be no ownership to the air or the sea. If we cannot own the air or the sea, neither can the government hold them as the trustee.
Scholars also maitain that any member of the public can sue the government if the government fails to perform the fiduciary duty because the public is the beneficiary. However, if the trust of the doctrine is a kind of the public trust(a.k.a. charitable trust), only the administrator could enforce the trust agains the trustee. Only if we define the Public Trust as the private trust the beneficiaries became the enforcer of the trust.
The author does not argue against the intervention of the government to the private property for public welfare. All he proposes in this article is that the doctrine, by depending on the traditional notions of property law and trust, inevitably conflicts with the purpose of the environmental protection movement.
