Post COVID19 사회 부문별 입법수요 연구 (A Study on the Legislative Demand of Post COVID19 by Social Sector)

초록

COVID19로 인한 온라인·비대면·비접촉 방식으로의 변화는 생활 전반에서의 문화적·제도적 대전환에 대한 공감대를 불러일으켰다. 또한 이로 인해 Post COVID19에 대응하기 위한 새로운 입법적 방법의 논의 및 행정 절차적 보완 및 신설 등 구체적인 검토의 필요성이 대두되었다. 이에 본 연구는 COVID19 이후 사회변화를 전망하고, 이에 대응하기 위한 법제도적 쟁점을 파악하기 위해 분야별 전문가 대상 포럼을 운영하고 그 결과에 대한 키워드 및 네트워크 분석, 주요 이슈 분석 등을 수행하였다. 2021년 2월부터 7월까지 약 5개월간 18회의 포럼이 개최되었으며, 이에 다양한 직군의 전문가 86명이 참여하였다.
포럼 분야별 주요 이슈 분석을 통한 법제도적 쟁점 도출한 결과 첫째, 행정 분야에서는 전자 행정서비스의 효율적이고 안정적 운영을 위한 개인정보 관련 법적 대응 방안, 공무원 재택근무 관련 법령 검토 등이 필요함을 확인할 수 있었다. 둘째, 교육 분야에서는 교육격차 해소를 위한 환경 조성, 원격수업으로 인한 출석 등 행정적 측면을 반영한 법 개정의 필요성을 확인할 수 있었다. 특히, 교육은 변화된 미래 교육 실현을 위해 발전적 측면에서 법제도가 고려되어야 함을 전제로 하고 있었다. 셋째, 가족·보건·의료분야의 경우 일-가정 양립을 위한 제도 마련, 원격의료에서의 환자 개인정보 이용 및 의료 사고 책임성 문제 등을 해결하기 위한 법제도의 필요성을 확인할 수 있었다. 한편 감염병 위험이 커지는 현시점에서 의료 안전성 제고, 취약계층 사회안전망 지원을 위한 재정 확보 등 역시 주요 이슈로 확인되었다. 넷째, 노동·산업 분야의 경우 새로이 등장한 플랫폼 노동자의 근로자로서의 신분 안정성 문제를 해결하고, 이들의 열악한 노동환경 개선을 위한 법제도 개선이 중요한 이슈로 확인되었다. 또한 플랫폼 경제에서의 개인정보 활용범위, 재택근무 정착을 위한 근무환경 변화를 위한 법제도 개선 등 역시 필요함을 확인할 수 있었다.
본 연구에서는 향후 변화 속도가 빠른 미래 사회에 적극적으로 대응하여 사회의 안정성을 확보하기 위한 전략을 제언으로 제시하였다. 이는 ‘타당성 높은 법제 마련을 위한 기초자료 확보’, ‘일관성과 통일성 기반 법제도 제·개정 필요’, ‘미래 사회에의 유기적 대응을 위한 법제도 수립 방향 및 절차 마련’이 그것이다.

영어초록

The change to online, non-face-to-face, and non-contact methods due to COVID-19 aroused a consensus for a great cultural and institutional shift in life. In addition, the need for detailed review such as discussion of new legislative methods to respond to Post COVID-19 and supplementation and establishment of administrative procedures has emerged. Accordingly, this study operated a forum for experts in each field to predict social changes after COVID-19 and to identify legal and institutional issues to respond to it, and analyzed the results of keywords and networks, and analyzed major issues. From February to July 2021, 18 forums were held for about 5 months, and 86 experts from various fields participated.
After that, legal and institutional issues were derived through analysis of major issues in each field of forum. First, in the field of administration, it was confirmed that it is necessary to take legal measures related to personal information for the efficient and stable operation of e-administrative services, and to review laws related to telecommuting of public officials. Second, in the field of education, it was possible to confirm the need to revise the law to reflect administrative aspects such as creating an environment for bridging the educational gap and attending due to distance learning. In particular, education was premised on the fact that the legal system should be considered from a developmental point of view to realize a changed future education. Third, in the case of family, health, and medical care, it was possible to confirm the need for a legal system to prepare a system for work-family balance, to solve the problems of patient personal information use in telemedicine, and responsibility for medical accidents. Meanwhile, at this point in time when the risk of infectious diseases increases, improving medical safety and securing finances to support the social safety net for the underprivileged were also identified as major issues. Fourth, in the case of labor and industry, it was identified as an important issue to solve the problem of identity stability of newly emerged platform workers as workers and to improve the legal system to improve their poor working environment. In addition, it was confirmed that the scope of personal information utilization in the platform economy and the improvement of the legal system for changing the working environment for the settlement of telecommuting were also necessary.
In this study, strategies for securing social stability by actively responding to the fast-changing future society were presented as suggestions. These are ‘Securing basic data for the preparation of a highly valid legal system’, ‘Need to enact and amend a legal system based on consistency and unity’, and ‘Prepare the direction and procedure for establishing a legal system for an organized response to the future society’.
