초록

본고에서는 문학비평과 법해석이 다의적인 텍스트를 대상으로 그 의미를 확정하는 동일한 작업을 진행한다는 점에 주목하여, 방법론적인 측면에서 양자의 관련성을 살펴본다. 구체적으로는, 문학비평과 법해석 각 분야에서 텍스트의 ‘불확정성’이 가지는 의미가 서로 어떻게 다른지 살펴보고, 그럼에도 양 분야가 해석활동의 본질을 ‘다의적인 텍스트를 대상으로 하여 논증을 통한 합의로써 상호주관적인 의미 확정에 이르는 과정’으로 동일하게 이해하고 있다는 점을 밝힌다. 이러한 작업을 통해 법해석 활동의 의의와 목표를 되돌아보고, 문학비평의 방법론을 법해석에 참고할 수 있는 이론적인 바탕을 마련하고자 한다.

영어초록

This article attempts to present an example of the intersection between theories of interpretation in literature and in law. Competing theories of statutory interpretation suggests different priorities between various elements to consider in interpreting a statute; such as legislative intent, the meaning of the words, etc. Such competing suggestions can also be found in the development of theories in literary criticism, where the focus of interpretation has moved from author to text, and then to reader.
This article first critically analyzes the common features of the aim and methods of literary and statutory interpretation. Despite the differing function of the two, they are both a form of logical argumentation in the context of precedents. This shared feature suggests the possibility and the utility of an interdisciplinary approach to law and literature.
This article then examines the interpretive theory of New Criticism and that of F. R. Leavis as examples of literary criticism and statutory interpretation sharing a similar methodology. Leavis regards the text as an objective substance independent from the author, serving as the “third realm” where the meaning of the words can be discussed based on the intrinsic elements of the text and the shared linguistic rules and practices of the interpretive community. This article argues that Leavis’ perspective on the nature of language and text suggests the possibility of enhancing determinacy in statutory language with resort to the linguistic practices of the legal community, while not neglecting the specificity of each case.
