무형유산에 대한 법인류학적 접근 (Legal Anthropological Approach to Intangible Heritage)

초록

국가유산체제 전환이 현안이 되고 있다. 무형유산 분야에서 국가유산체제 전환은 무형유산체제 전환을 의미한다고 볼 수 있다. 이 체제 전환은 법률과 정책의 전환을 의미하는 것으로 이해된다. 그러나 무형유산은 법률적 체계임과 동시에 법률과 층위를 달리하는 제도적 의미를 담고 있기도 하고, 생활세계에 존재하는 문화적 실제이기도 하다. 문화재보호법과 무형문화재법으로 대변되는 한국의 무형유산체계 내에서도 무형문화유산보호협약의 이행과 관련하여 무형문화재와 무형문화유산의 이중적 체계가 존재하여 왔다.
무형유산체제 전환을 다양한 각도에서 접근할 필요가 있다. 그리고 그러한 접근의 관점과 방법을 법인류학이 제공하고 있다고 볼 수 있다. 법철학자 웅거는 법을 관습적 법, 관료적 법, 법체계라는 세 개의 수준으로 구분한다. 이러한 관점은 법인류학에 수용이 가능하고 무형유산을 법체계와 생활세계를 통합적으로 접근하는데 있어서도 유용하다. 무형유산의 법체계와 구분되는 생활세계 속 무형유산의 존재 및 이것들의 통합적 설명이 법인류학의 역할이라고 볼 수 있다. 여기서 생활세계 속 무형유산은 관습법이나 강제적 가치에 대한 말리노프스키나 호블의 관점을 통해 설명할 수 있고, 통합적 설명은 토이브너의 ‘성찰적 법’을 통해 구현할 수 있을 것으로 보인다.
무형유산체계와 관련하여 인류학이 역할을 할 수 있는 연구과제는 관습규범과 실정법의 관계 규명, 전통지식의 권리 설정, 입법과 사법에서의 언어 분석, 문화다원주의의 도입 타당성 분석 등이 대표적일 것이며, 무형유산체제전환의 의미를 밝히는 작업도 포함될 수 있을 것이다.

영어초록

The transition to a national heritage system is currently an issue of concern. In the intangible heritage field, the transition to a national heritage system can be understood as a transition in the intangible heritage system. This transition is understood to involve a shift in laws and policies. However, intangible heritage carries both a legal framework and a institutional significance that distinguishes it from legal systems. It is also a cultural reality in the everyday world. Within Korea's intangible heritage system, represented by the Cultural Heritage Protection Act and the intangible heritage Act, there has been a dual system regarding the implementation of the intangible heritage Protection Agreement in relation to intangible heritage.
It is necessary to approach the transition to the intangible heritage system from various perspectives. Legal anthropologists provide perspectives and methods for such an approach. Legal philosopher Unger divides the law into three levels: customary law, bureaucratic law, and legal systems. Such perspectives are compatible with legal anthropology and are also useful in the comprehensive approach to integrating intangible heritage with legal systems and the everyday world. The role of legal anthropology can be seen in the existence of intangible heritage in the everyday world, distinct from the legal system, and in the integrated explanation of these. In the everyday world, intangible heritage can be explained through or Malinowski‘s view on the customary law and Hoebel’s views on jural postulates, and an integrated explanation can be achieved through G. Teubner's reflexive Law.
Regarding the intangible heritage system, research tasks that anthropology can perform include clarifying the relationship between customary norms and practical law, establishing the rights of traditional knowledge, language analysis in legislation and jurisprudence, and an analysis of the feasibility of cultural pluralism. These tasks may also include work to elucidate the significance of the transition to the intangible heritage system.
