미국 대북제재법의최근 동향 및 전망 (Current Trend and Prospect of North Korea Sanctions Act in the U. S. Congress)

초록

북한의 4차 핵실험 이후 유엔을 비롯한 국제사회의 대북제재가 강화되어왔으며 미국 의회에서 최초로 북한만을 대상으로 하는 『2016 대북제재 및 정책강화법 (North Korea Sanctions and Policy Enhancement Act of 2016, H.R.757)』이제정된 바 있다. 그동안 북한 비핵화 국면에서 미국의 트럼프 행정부의 입장에 주목해 왔으나 실제로 최근 핵심적인 미국의 대북제재는 의회가 제정한 법률에 근거하고 있다는 점에서 그동안 다소 간과되어 온 미국 의회의 입장을그동안 제정된 대북제재 관련법 및 최근 발의되고 있는 대북제재 관련 법안들의 흐름을 통해 고찰할 필요가 있다. 이를 살펴보면 대북제재 유예 및 해제요건으로 북한 비핵화뿐만 아니라 북한 인권 개선 여부가 점점 더 강조되고있었으며, 행정부의 의회에 대한 보고의무 등 의회의 관여가 확대되는 경향을보이고 있음을 알 수 있다. 또한 대북제재의 회피를 방지하기 위해 금융제재적용 범위 및 조력자에 대한 제재가 강화되고 있다. 그리고 단순히 대북 정책적 관점에서 만이 아니라 미국이 대외적인 외교정책에서 표명하는 ‘인권과 민주주의’라는 ‘가치’의 측면에서 접근하고 있었으며, 특히 아시아, 인도⋅태평양지역에 대한 외교 정책과 연결되어 있어 대북제재 관련 이슈에 있어서는 미의회 내에서 초당파적인 의견일치를 보이고 있다는 점을 알 수 있다. 이렇게미 의회에서 비핵화 외에 보편적 인권과 민주주의 등 ‘가치’적 측면을 강조하고 있다는 점은 우리 헌법 제4조에서 몰가치(沒價値)적 ‘평화통일’이 아니라‘자유민주적 기본질서에 입각한’ 평화통일이라고 규정하여, ‘가치’적 측면을역시 강조하고 있는 우리 헌법 정신과 부합하는 측면이 있다고 볼 수 있다.
향후 우리 정부의 대북, 통일 정책 추진과정에서 단지 미 행정부의 움직임에만 초점을 둘 것이 아니라 미국의 대외정책을 입법적으로 결정하는 미 의회의입법 흐름에 대하여 더욱 주목하고 연구할 필요가 있다.

영어초록

After North Korea’s fourth nuclear test, it has appeared that international sanctions,including the United Nations (UN), against North Korea have strengthened.
Especially, in the U.S Congress, enactment of the North Korea Sanctions and PolicyEnhancement Act of 2016, which for the first time was meant to exclusively targetNorth Korea, was a representative one. Indeed, there have been attentions on an issueof what will be a position Trump administration would take, as entering a phase ofsteps toward the denuclearization. Given a point that U.S. sanctions regime isgrounded in the legislations enacted by the Congress, however, this paper would liketo raise a necessity of understanding a stance of the Congress on North Koreasanctions, which has been somewhat inactively dealt with, by contemplatinglegislative flows within the enacted legislations and bills that have been issued inrecent years. As looking into the part, it is found that not only North Korea’sdenuclearization but a promotion of human rights situations have been furtheremphasized as a requirement of sanction relief or its termination. In addition, thereappears a trend of which an extent of the Congress’s engagement appears to haveexpanded to regulating the reporting obligations by the Administration before it. Also,it is found that in order to prevent North Korea’s sanction evasions an extent towhich financial sanctions may be applicable and level of imposition of the sanctionsagainst North Korea’s enablers have consolidated and that a bipartisan consensus onNorth Korea sanctions-related issues appears to have been formed, not solely in termsof North Korea policy-perspective but also in light of the aspect of ‘value’, so called‘human rights and democracy’ expressed in the U.S. foreign policy, for it isintertwined with the foreign policy in adversaries, Asia as well as Indo-Pacific region. Therefore, in the process of promoting unification policy, the government ofthe Republic of Korea needs to pay more attention and research on the legislativestream arisen in the U.S. Congress, in which the foreign policies are determined atlegislative level, rather than to solely put a focus on the moves in the U.S.
administration.
