칠레의 남극활동에 관한 국내법 (Analysis of Chile’s Domestic Laws Regarding Antarctic Activities)

초록

남극조약은 군사적 사용을 금지하고 과학적 연구의 자유를 보장함으로써, 잠재적 분쟁을 예방하고 평화로운 학술 활동을 촉진하는 역할을 해왔다. 특히 영유권 주장에 대해서는 동결 원칙을 적용하여, 관련 분쟁이 격화되는 것을 막고 국제사회의 협력을 유지하도록 유도한다. 1991년 체결된 마드리드 의정서는 환경 보호를 강화하고 남극활동에 대한 엄격한 규제를 도 입하였다. 남미국가는 지리적인 근접성을 바탕으로 남극조약체제에 적극 참여하며 자국의 주 권과 국익을 보호하는 경우가 많다. 칠레는 남극에서 국제 사회와 협력하며 환경 보호와 경 제 발전을 균형 있게 추진하고, 남극활동에 관한 여러 규범을 발전시키며 국제사회와의 공 존, 역내 협력 강화, 경제 발전과 환경 보호의 균형을 추구한다. 칠레의 정책과 법제는 남극 조약체제와 대체로 정합성을 가지지만, 영유권 주장 등 일부 논제에서는 국제사회의 다자간 규율체계에 도전적인 면도 있다. 특히 2020년에 제정된 칠레의 새로운 남극법은 남극에 대 한 주권적 권리를 공고히 하고 남극활동 역량을 개선하며 국제 사회에서의 영향력을 확대하 려는 목적이 뚜렷하다. 한국은 칠레와 같은 남미 국가와 협력하여 남극 문제에 적극적으로 참여하고, 국제사회에서의 역할을 확대할 필요가 있다.

영어초록

The Antarctic Treaty serves as a fundamental mechanism for preventing disputes and promoting peaceful research through several key principles. Military activities are strictly prohibited within the Antarctic region under the Treaty’s provisions. The Treaty guarantees freedom for scientific investigation, enabling international collaboration. Territorial claims remain frozen under this agreement, neither recognized nor dismissed. The Madrid Protocol, which was signed in 1991, substantially strengthened environmental protection measures for Antarctica. This Protocol introduced particularly rigorous regulations governing all human activities in the region. South American countries strategically leverage their geographical proximity to Antarctica to maintain active participation in the Treaty System. These nations seek to protect their sovereignty through engagement with Antarctic governance structures. National interests, spanning scientific, economic, and geopolitical concerns, further motivate South American involvement in Antarctic affairs. Chile has established a productive pattern of cooperation with the international community regarding Antarctic matters. Chilean policy carefully balances environmental conservation priorities with economic development opportunities in the region. Through diplomatic engagement, Chile advances various normative frameworks related to Antarctic activities. Most Chilean policies and legislative measures align with the Antarctic Treaty System’s objectives and requirements. Certain aspects of Chile’s approach, particularly regarding territorial claims, create tensions within the multilateral governance framework. These challenges reflect the inherent difficulty of reconciling national interests with international regulatory mechanisms. In 2020, Chile enacted comprehensive new Antarctic legislation with significant implications for regional governance. This law explicitly aims to reinforce Chile’s sovereign rights over its claimed Antarctic territory. The legislation additionally seeks to enhance Chile’s scientific and economic activities in the region. Increasing Chile’s influence within international Antarctic forums represents another strategic objective of this law. South Korea should adopt a more proactive approach to engagement with South American nations on Antarctic issues while expanding its role in the international community.
