간병비 급여화의 법적 쟁점 (Legal Issues on Care Benefit)

초록

Recently, the government has been promoting to pay for care within medical institutions as one of its policies to strengthen health insurance coverage. However, only the practical issues related to the policy direction and funding are discussed with regard to the care benefit, which is represented by the Integrated Nursing and Caring Service, but there has been no full discussion on the various legal issues accompanying the policy. This article examines how care within hospital is handled in the current social insurance system and deals with some legal issues that are accompanied or should be discussed together when paying for care within medical institutions.
Firstly, I review the policy and the problems of Integrated Nursing and Caring Service that the government is promoting as a measure to pay for care, and examine the appropriate legislative method for care benefit considering the normative relationship between nursing and care.
As another legal issue, the current law lacks measures paying for elderly care or care within Care Hospital. It is necessary for care hospital to restore its medical function for the implementation of the benefit for elderly care, and the introduction of the appropriateness evaluation system for care hospitals is considered as one of such measures. This article examines whether the introduction of such a system is not problematic or not from the point of view of the fundamental rights, and what issues must be addressed together with introduction of such system.
