「학교체육진흥법」제정을 위한 과제 (Legal Issues on the Enactment of the School Physical Education Promotion Act)

초록

이 글에서는 지금까지 제안되었던 법안의 문제점을 보완하고 각계각층의 여론을 수렴하여 박영아 의원이 마련한 「학교체육진흥법」시안을 검토·분석하고, 이 법의 올바른 법안의 내용을 제시해 보고자 한다.
현행 교육관계법령이나 스포츠관련 법령을 살펴보면 이러한 학교체육의 위기를 극복하고, 학교체육진흥을 위한 법적 토대가 마련되어 있지 않기 때문에 「학교체육진흥법」의 제정은 꼭 필요하다고 볼 수 있다.
이 법의 제정을 위한 법정책적 과제는 다음과 같이 제시하였다.
첫째, 교육기본법에 명시되어 있는 “홍익인간(弘益人間)”의 교육이념과 우리나라 근대 교육의 목표였던 “덕양(德養; 덕을 기름), 체양(體養), 지양(智養)의 조화”를 통하여 모든 국민이 인격을 도야(陶冶)하고 자주적 생활능력과 민주시민으로서 필요한 자질을 갖출 수 있도록 근본적으로 학교체육를 정상화시켜야 한다.
둘째, 국가와 지방자치단체는 학교체육진흥을 위한 기본정책을 수립하고 물적·인적 토대를 마련하여 시행할 책무를 이행하여야 한다. 각급 학교에서 체육교과과정의 운영을 충실하게 하여 수업의 질을 향상시키고, 학교운동부와 스포츠클럽의 효율적인 운영을 통하여 학생체력건강을 향상시킬 수 있도록 정책을 추진해야 할 것이다. 또한 학생체력건강평가(PAPS)와 스포츠클럽활동 등과 같은 학교체육의 성과를 상급학교 입시에 반영할 수 있는 제도를 도입해야 한다.
셋째, 학생선수의 인권과 학습권이 침해되지 않도록 제도적인 근거를 마련하여야 한다. 체육특기자 입시제도의 개선, 학생선수지도자의 자격과 양성제도 및 처우개선, 신분보장 등을 통하여 각종 부정부패·비리를 방지하고 폭력·성폭력이 근절될 수 있도록 해야 한다.
넷째, 학교체육을 정상화시키려면 무엇보다도 재원확보가 이루어져야 한다. 학교체육진흥을 위한 학교체육시설, 학교운동부지도자의 처우개선, 건강체력평가제도의 실시, 스포츠전문강사의 배치 등 인프라를 구축하는데 많은 재정이 필요하다. 학교체육진흥기금이나 학교체육진흥재단의 설치를 신중히 고려해 볼 때라고 생각한다.
다섯째, 학교체육진흥을 위한 행정기관의 확대와 연구기관의 설립이 필요하다고 생각한다. 다양한 학교체육 사업을 추진하기 위해서는 인적자원이 너무나 부족한 편이다. 원활한 업무수행을 위한 담당부서의 격상, 확대 강화가 필요하다고 본다. 또한 학교체육의 진흥을 위하여 지속적인 연구와 프로그램개발, 정책개발, 지도자연수 등을 담당할 기관이 필요하다.

영어초록

In this paper, I tried to point out necessities and right directions for enactment of the School Physical Education Promotion Act. There was a lot of discussion about this matter, which have been put forward as bills including proposals of members of the Korean Parliament, Park Young-A and An Minseok in the National Assembly.
Instead of trying to set short-term targets right away, what needs to be done is set a direction and come up with answers on what needs to be done. If we would look all around carefuuly about the Laws related to the Education and Physical Education, there are no legal base for school physical education promotion to get over a crisis of such school physical education. Therefore it should be certainly necessary to legislate new law in this field.
I would like to show the problems and legal policies of the School Physical Education Promotion Act as follows:First of all, we should return to normality of the physical education in school through the realization of Humanitarianism, our nation's founding principle and ideals of education iin the Baisic Education Act, which were exhibited by the Fundamental Law of Education and modern times of our country.
The second, nation and local government must carry out a duty they prepare, and to enforce material human base establishing a basic policy for school physical education promotion. We must promote a policy to be able to advance with student physical strength health through the administration that is school athletic sports club. In addition, we must introduce the reflex system that there is into an upper school entrance examination by student physical strength health evaluation (PAPS) and result of the school physical education such as the sports activities.
The third we have to prepare for system-like grounds so that human rights and learning right of student are not infringed. Violences related to the system of the Student Athletic Scholarship and various injustice corruption should be prevented by the new law.
The fourth, it should be secured a budget and made up of the financial reforms for the school physical education promotion though the building infrastructure including the placement of the lecturer specialized in a school physical education institution for school physical education promotion and the enforcement of the healthy physical strength evaluation system. I think carefully with time I consider the setting of a school physical education promotion fund or the school physical education promotion foundation.
The fifth, I think expansion of the administration for school physical education promotion and establishment of the research organization are necessary. Diverseness is the which is lack so that human resources remain to promote it which valued the school physical education that I did. I consider that the upgrading of the charge post for smooth duties accomplishment, extended reinforcement are necessary. In addition, an engine in charge of sustained study and program development, policy development, the leader training for promotion of the school physical education is necessary.
