중국 해상법 개정 내용과 시사점 (Amending Content and Implication of Chinese Maritime Law)

초록

중국의 현행 해상법은 일찍이 1951년에 제정 작업을 시작했으나 40여 년이란 오랜 작업 끝에 1993년에 시행되었다. 동 법은 중국이 건립된 후 처음으로 국제조약을 기초로 하여 제정한 국내법이었고 당시 중국의 국내법에서 가장 체계적인 법률 중의 하나였으며 278개의 조문으로 조문이 가장 많았다. 동 법은 시행 30여 년간 중국의 해운 산업 발전에 긍정적인 역할을 했을 뿐만 아니라 경제발전 및 국제무역의 촉진에도 중요한 작용을 했다. 다만 동 법이 시행된 이래 많은 국제조약이 수정 및 제정되어 국제적 해운 입법에 뒤처져 갔고, 일련의 국내법이 개정 및 제정되어 조화를 이루지 못했으며, 더 이상 경제발전 또는 국제무역의 촉진에 부응하기 어렵다는 과제를 안고 있었다.
동 법이 시행 후 24년이 지난 2017년에 개정 작업은 시작되었으나 지금까지 몇 년째 개정 작업은 진행 중이다. 즉, 2018년 “해상법 개정 초안”이 작성된 바 있고, 2020년에 2018년 개정 초안을 기초로 수정한 “해상법 개정안”이 작성되었다. 특히, 2024년 8월 30일, “해상법 개정안”이 국무원 상무위원회 회의에서 원칙적으로 통과됨에 따라 빠른 시일 내에 시행될 것이라는 가능성을 보여주고 있다. 동 개정안은 동 법의 136개의 조항을 수정했고 69개의 조문을 신설하여 총 336개 조문으로 구성되어 있으며 전반적인 내용을 수정 및 보완했다. 본 문은 동 개정안의 전반적인 내용을 요약 정리함과 동시에 조문의 수정 및 신설이 가장 많은 부분인 “제2장 선박물권”, “제4장 해상화물운송계약”, “제12장 선박유류오염 손해책임(신설)” 부분을 중심으로 서술했고, 이에 대응되는 시사점으로 “해상법 적용 범위를 확대”, “해상운송 증서의 전자화에 대응”, “선박유류오염 방지를 강화”했다는 점을 서술했다.

영어초록

China's current maritime law was drafted as early as 1951, but was only implemented in 1993 after more than 40 years of work. This law is one of the first domestic laws formulated on the basis of international treaties after the establishment of China, and is considered one of the most systematic laws in China’s legal system at the time. With 278 articles, it was also the law with the greatest number of articles.In its first 30 years of implementation, the Law played a positive role in the development of China's shipping industry, as well as an important role in promoting economic development and international trade. However, since its implementation, numerous international treaties have been amended and enacted, causing the law to gradually fall behind the evolving trends in international maritime legislation, and a series of domestic laws in China have also been revised and introduced, resulting in a lack of harmonization between Chinese maritime law and other domestic laws and no longer meeting the challenges of economic development and the promotion of international trade. In 2017, 24 years after the Law’s implementation, the revision process began, but it has been ongoing for several years now. In 2018, the “Draft Revision of the Maritime Law” was prepared, and in 2020, the “Revision of the Maritime Law” was prepared, which was revised based on the 2018 draft. In particular, on August 30, 2024, the “Amendments to the Maritime Law” was approved in principal by the Standing Committee of the State Council, indicating that it will likely be implemented in the near future. The amendments amended 136 articles of the Law and added 69 new articles, totaling 336 articles, and generally revised and supplemented the content. This article summarizes the overall content of the amendments, focusing on the sections with the most amendments and new articles, namely “Chapter 2, Real Right of Ships”, “Chapter 4, Contract of Carriage of Goods by Sea” and “Chapter 12, Liability for Ship Oil Pollution Damages (New)”. On this basis, the article further summarizes the corresponding implications, namely “expanding the scope of maritime law”, “responding to the electronicization of maritime transportation documents” and “strengthening the prevention of ship oil pollution”.
