초록

본 논문은 운송인의 인도지연 책임에 관한 연구로 화물의 인도지연시 해상운송인의 책임이어떻게 되는지, 그리고 이에 관한 입증책임은 누구에게 있는지에 대한 내용을 로테르담 규칙과 중국 해상법을 상호비교하여 시사점을 제시하고 있는 논문에 해당한다. 이에 본 논문은 로테르담 규칙과 중국 해상법상 인도지연의무와 이에 관한 운송계약상의 약정, 인도지연 책임의범위 및 입증책임에 관한 규정을 상세히 살펴보도록 한다. 이를 위해 관련 주석서와 논문들을검토하여 관련 규정 내용의 해석상 기초로 삼고자 한다. 또한 본 논문은 로테르담 규칙과 중국해상법상 인도지연에 관한 규정을 상호 비교 연구한 후 어떠한 차이점 있는지 살펴보도록 한다. 이와 더불어 본 논문은 이러한 비교 검토를 통하여 차이점이 있는 경우 중국 해상법의 개정 방향이나 올바른 해석 방향에 관한 시사점을 도출하도록 한다

영어초록

Purpose : The research objective of this paper is to conduct a comparative analysis of the Rotterdam Rules and the Chinese Maritime Law regarding the liability of the carrier for delivery delays in maritime transportation of goods and the question of who bears the burden of proof.
Additionally, the study aims to identify the differences between the Rotterdam Rules and the Chinese Maritime Law based on this comparative research and provide legal implications accordingly.
Research design, data, methodology : In order to achieve the purposes of the study, it executes a comparative study of the rules as to the carrier’s liability for delay in delivery of cargo and the burden of proof under the Rotterdam Rules and the Chinese Maritime Law. The basic question for this comparative study is placed on whether a solution from one jurisdiction is more logical than the others and to what extent each jurisdiction has responded to protect the reasonable expectations of the parties in the rules as to the liability of the carrier for delivery delays.
Results : After making a mutual comparative study of the Rotterdam Rules and the regulations on delayed delivery in China's maritime law, the paper tries to draw some implications regarding the direction of revision or correct interpretation of China's maritime law in case of differences.
Conclusions : The Chinese Maritime Law makes us puzzle over the meaning of "cases within a clearly stipulated time" for the carrier’s liability for delayed delivery and its burden of proof. It is suggested that the relevant regulations will need to be revised in order to reduce the controversy over the liability of the carrier for delayed delivery
