    초록

    Today, demand for aviation and aviation market is expanding, due to the expansion of economic and trade. Single market is emerging as a global aviation market. In 2011, the number of overseas travelers in Korea reached 12 million and trade volume has surpassed the $ 1 trillion. Accordingly, the growth of the aviation industry as air transport companies and airport projects, is large. the movement of people and goods through aviation is increasing. The development of aviation technology behind it is.
    Accordingly, in the field of aviation-related laws leading necessary a new order to meet the changing aviation environment, practically reform of aviation legislation to respond the development of the aviation industry is required. But Aviation Law has not been able to respond promptly. Despite revised 53 times, Aviation Law has not adequately cope. This should be supported by appropriate law and institutional maintenance claims have been raised continuously.
    The Minstry of Land, Transport and Maritime Affairs was announced in the notice of Aviation Law.
    To dissolve current the Aviation Law, and consolidation or abolition of laws and suggesting that the dissolution of Civil Aviation through the legal system was centralized. It was suggesting that the Aviation Act shall be abolish, and merger with the relevant laws and streamline the system of Aviation Law. The contents of the Aviation system is vast and complex, and work efficiency is low, because the legal system make it difficult to understand.
    But rather than to divide Aviation Law by splitting, it is desirable to maintain. By complementing the Aviation Law as Mixed for Public-Private Law, it is desirable to establish its position as the Framework Act. This universality and global unity on the basis of international law was enacted and is only itself reflects the demands of the times.
    It was that Convention on international Civil Aviation, including the various international treaties and conventions and protocols to accommodate the contents of the law is reflected. United States or the United Kingdom and Japan and other countries also carried out as the Civil Aviation Act and the configuration of the system is maintained. If the Framework Act on the Aviation Law does not exist, several individual legal contradictions between the different and are more likely to cause confusion.
    Framework Act on Aviation Law is maintained as a condition, 「Aviation Business Act」ㆍ「Aviation Safety Act」ㆍ「Aviation Facilities Act」ㆍ「Aviation Security Act」 should be legislated. It was the relevant Aviation Law, announced in the bill by the Minstry of Land, Transport and Maritime Affairs. In addition, 「Aviation Insurance Law」ㆍ「Aviation Tax Law」ㆍ「Aviation Traffic Law」 relating to a variety of aviation legislation to the legislation is expected to be continued.
