우주법의 체계와 국내 우주법상 주요 쟁점(part 1) - 발사 및 등록에 관한 비교법적 검토 - (The Structure of Space Law and Major Issues in Domestic Space Law (Part 1) - A Comparative Legal Review of Regulations on the Launch and Registration of Space Objects -)

초록

필자는 우주항공기술 개발 및 관련 산업 진흥에 관한 업무를 전담하는 우주항공청의 설치에 즈음하여, 우주법의 주요 쟁점들을 순차적으로 검토하고자 한다. 본고는 이러한기획의 일부로서, 우주법 관련 논의의 전제가 되는 국제 우주법의 기본 체계를 살펴보고, 우선 ‘우주개발 진흥법’상 우주물체 발사 및 등록에 관한 규율 체계를 국제 우주법과 주요국의 관련 입법례와 비교하여 검토하고 그 개선방안을 제시한다.
우선 국제 우주법의 체계와 관련하여, ‘우주 조약’을 필두로 한 경성 우주법 및 여러 가지 연성 우주법들에 관하여개관한 후, 우주물체 발사 및 등록에 관한 규정을 보다 구체적으로 살펴본다. 이어서, 미국과 일본의 우주발사체 발사및 우주물체 등록에 관한 규제가 어떻게 이러한 국제 우주법의 요청을 반영하면서도 자국의 사정에 따라 유연하게 형성되어 있는지를 검토한다. 이를 기초로 우리 우주개발 진흥법의 규정을 검토함으로써, 우리 우주개발 진흥법이 발사허가 후 발사실시자에 대한 감독권 행사, 발사허가와 탑재체 심사기준, 우주쓰레기 경감을 위한 조치 등에서 개선의필요가 있음을 논한다. 또한, 동법상 발사허가 의무자와 우주물체 등록 의무자의 불일치, 예비등록 제도의 실효성 결여, 우주물체 등록 절차의 비효율성 등에 관하여도 주의를환기한다.
국제 우주법의 요청에 대한 부응 및 안전하고 지속가능한우주개발을 위하여 우주개발 진흥법의 개정이 필요하며, 이과정에서 국제 우주법의 준수, 국가안보와 외교적 이익, 국내 우주산업 발전, 우리 국민의 보호 등 다양한 요소가 균형있게 고려되어야 할 것이다.

영어초록

As the Korea Aerospace Administration is being established to oversee the development of aerospace technology and the promotion of related industries, the author intends to sequentially review major issues in space law. This article, as part of such a project, examines the basic framework of international space law, which serves as a premise for discussions on space law. It then reviews the regulatory system for the launch and registration of space objects under the Space Development Promotion Act by comparing it with international space law and relevant legislation of the U.S. and Japan, and suggests improvements.
First, with regard to the framework of international space law, after an overview of the binding space law led by the Outer Space Treaty and various forms of soft space law, the provisions concerning the launch and registration of space objects will be examined more specifically. Following this, it will review how the regulations on the launch of space launch vehicles and registration of space objects in the United States and Japan reflect the demands of international space law while flexibly adapting to their respective national circumstances. Based on this, by examining the provisions of our Space Development Promotion Act, it will argue that our Space Development Promotion Act needs improvement in areas such as exercising supervisory authority over launch operators after launch authorization, criteria for launch authorization and review of payloads, and measures to mitigate space debris. It will also draw attention to the discrepancy between the entities obligated to obtain launch authorization and register space objects, the lack of effectiveness of the pre-registration system, and the inefficiency of the space object registration procedure under the same Act.
In order to comply with the requirements of international space law and to ensure safe and sustainable space development, it is necessary to amend the Space Development Promotion Act. In this process, various factors such as adherence to international space law, national security and diplomatic interests, development of the domestic space industry, and protection of our citizens should be balanced and considered.
