중대재해처벌법의 법적 쟁점과 법정책 과제 - 기업의 안전보건조치 강화의 관점에서 - (Legal Issues and Legal Policy Tasks of the Severe Accident Punishment Act – From the Perspective of Strengthening Safety and Health Measures of Enterprises -)

초록

최근 우리 사회는 가스 질식 사망사고, 화력발전소 압사사고, 물류창고 건설현장 화재사고와 같은 “산업재해”와 여객선 침몰 사건, 가습기 유출 사고와 같은 “시민재해”에 직면하면서 사회안전망 구축 및 보건의료 체계의 확보에 주안점이 두어져 왔다. 그 결과물이라 할 수 있는 “중대재해 처벌 등에 관한 법률”이 2021년 1월 8일 국회를 통과하여 1월 26일 공포되었다. 앞으로 시행령 제정 등 중대재해처벌법 시행에 앞서 다소 간의 절차가 남아 있다. 그러나 궁극적으로 이 법의 제정과 시행에 따른 사업주 등 기업의 의무와 책임이 강화된다는 점에서 우리 사회와 경제에 어떠한 영향을 미칠 것인지에 대한 관심이 집중되고 있다. 이미 강화된 개정 산업안전보건법과 대법원의 산업안전 양형기준과 관련하여 사업주 등에 대한 책임이 보다 강화되고 있기에 중대재해처벌법이 우리 사회에 미칠 수 있는 변화를 진단하고 합리적인 대응 방안을 모색하는 것은 의미가 크다 할 것이다. 이 법과 관련하여 경영책임자등의 해석 범위, 산업안전보건법과의 관계, 중대산업재해의 적용 범위, 제조물책임법과 관계 등이 쟁점이 되고 있으며 헌법상 명확성 원칙 위배 또는 과도한 위임입법으로 인한 위헌 논쟁도 제기되고 있다. 이 글에서는 위헌 문제에 관한 논의보다는 중대재해처벌법의 정상적인 시행을 전제로 즉, 실용적인 관점에서 사업주 등 기업의 대응 방안을 제언하였다. 먼저 이 법의 주요 내용을 검토 및 평가하고 관련 법적 쟁점을 살펴보았다. 이어서 사회안전망 구축을 위한 기업의 안전보건조치 방안과 정부의 역할 등 그 방향성에 대하여 논의하였다. 중대재해를 획기적으로 줄이기 위해서는 처벌만이 능사가 아니라 안전보건조치를 강화하는 등의 예방조치와 재발 방지 및 추가 손해를 줄이기 위한 적극적인 노력이 필요하다.

영어초록

Recently, our society has focused on establishing a social safety net and securing a health care system as it faces “industrial accidents” such as gas suffocation deaths, thermal power plant deaths, fire accidents at logistics warehouse construction sites, and “civil disasters” such as ferry sinking, humidifier leaks. As a result, the “Act on Punishing Severe Disasters, etc.” passed the National Assembly on January 8, 2021 and was promulgated on January 26, 2021. In the future, some procedures remain ahead of the enforcement of the Act on Punishment of Critical Accidents, including the enactment of the Enforcement Decree. However, attention is focusing on how the Act will affect our society and economy in that it will ultimately strengthen corporate obligations and responsibilities, including business owners. As the responsibility for employers and others is already strengthened in relation to the enforcement of the revised Industrial Safety and Health Act and the Supreme Court's industrial safety sentencing standards, it will be meaningful to diagnose the changes that serious accident penalties can make to our society. Regarding this Act, the scope of interpretation by management managers, relationship with the Industrial Safety and Health Act, coverage of serious industrial accidents, and the relationship with the Manufacturing Liability Act are also raised. This article excluded discussions on the unconstitutionality issue and sought countermeasures against business owners and other companies based on the implementation of the Act on Punishment of Critical Disasters, which passed the National Assembly from a practical point of view. First, the main contents of the Act were reviewed and evaluated, and related legal issues were examined, and the direction of the law was discussed, such as the safety and health measures of companies and the role of the government to establish a social safety net. In order to drastically reduce serious disasters, active efforts are needed to reduce preventive measures and additional damages, such as strengthening safety and health measures, not just punishment.
