통일한국의 국가승계에 대한 법적 검토:국제법상 조약의 국가승계를 중심으로 (Legal Review of State Succession of future Unified Korea: With a Special Reference to Succession to Treaty Rights and Obligations)

초록

국가승계는 일정한 영토의 종국적 변경에 따라 선행국이 당해 영토와 관련하여 가지고 있던 권리·의무들이 당해 영토를 새로 획득하는 국가, 즉 승계국에게로 이전되는 것을 의미한다. 국가승계에 관하여는 현재 UN 국제법위원회가 준비한 2개의 조약과 1개의 UN 총회 결의가 성립되어 있다. 그러나 남북한 모두 국가승계에 관한 이들 조약에 가입되어 있지 않으므로 남북통일 후 남북한이 적용 의무를 가지는 국제조약은 현재로서는 없다고 할 수 있다.
그러나 남북한이 통일이 되면 통일한국은 해결해야 할 수많은 문제에 직면하게 된다. 그러한 문제에는 국내법으로 처리할 대내적 문제와 국제법에 의하여 처리 할 대외적 문제가 있다. 특히 국제법적인 문제는 통상적으로 국가승계 문제가 될 것이다. 국가승계는 한국으로서 특별한 관심을 기울일 수밖에 없는 주제이며 그 중에서도 가장 중심이 되는 것은 남북한이 각각 체결한 기존의 조약에 대한 처리이다. 우리는 통일 후 닥칠 수 있는 각종 대외관계에 있어서의 혼란을 막기 위해 조약 처리에 대해 어떠한 입장을 취할 것인지 바람직한 방향을 모색할 필요가 있다.
이에 본 연구는 먼저 국제법상 국가승계 이론에 대해 살펴보고 그러한 이론들이 통일한국에 있어서 적용되는지 검토한다. 아울러 남북한과 유사한 분단국 통일의 사례라고 할 수 있는 독일의 통일 이후 동·서독이 각각 체결한 기존의 조약을 어떻게 처리하였는지 살펴본다. 마지막으로 한국과 조약승계를 논하는 장에서는 남북한의 법적지위와 통일 이후 통일한국이 한국 및 북한이 각각 체결한 기존의 국제조약과 관련하여 제기되는 국가승계에 대해 법적 검토를 하고자 한다.

영어초록

A succession of states is defined to mean ‘the replacement of one state by another in the responsibility for the international relations of territory. However, this is more or less confusing, and where, by operation of law, international rights and obligations may pass to a successor state. As for state succession, there is no general principle in international law of succession as between states, no complete juridical substitution of one state of the old state, which has lost or altered its identity, but there are only two international conventions on state succession, engaged by the UN International Law Commission in treaty-making process, and one legally non-binding UN General Assembly Resolution. As for unification of South and North Koreas, these international documents are not applicable to the succession-process since neither South and North Korea are affiliated with the two UN Conventions.
But if South and North Koreas are reunified, future unified Korea will probably encounter a lot of legal problems to solve, not only internal problems to be dealt with by national law but also external matters governed by public international law. This article focuses on the latter topic, the external problems of state succession to which the Republic of Korea (South Korea) has paid attention in the context of foreign relations. Among various issues of state succession, including treaty rights and duties, non-fiscal contractual rights and duties, public debts, concessionary contracts, public funds and public property and so forth, this research mainly deals with the prepositional and principle issue, succession to treaty rights and obligations. We need to seek a desirable direction on what stance to take on the handling of the treaty to prevent confusion in various external relations that could arise after reunification.
In the beginning, this study examines the theories concerned with state succession under public international law and the applicability of such theories to the case of the reunification of Korea in the future. And then this article analyses the state succession practices in the reunification process between West and East Germanies as the referable precedent due to political and historical similarities with Korea. Regarding the German case, the last part deals with two main issues, the legal status of South Korea and North Korea under international law, and specific legal issues of the existing international treaties signed by South Korea and North Korea after reunification.
