남북한 혼인법의 통합방안 (The Integration Plan of the Marriage Law Between South and North Korea)

초록

이 논문은 북한 가족법에서의 혼인 및 이혼 관련 규정들을 살펴보고, 이를토대로 남북한 혼인법을 비교하고 그 통합방안을 제시하고 있다.
먼저, 북한 혼인법에 아직 관련규정들이 없거나 혹은 우리 민법과 비슷한규정들이어서 통합에 별 어려움이 없는 것들인데, 즉 약혼, 부부간의 의무, 협의상 이혼, 재판상 이혼의 절차, 양육권자의 결정, 면접교섭권, 재산분할청구권등이다. 이 경우에는 우리 혼인법의 규정이 통일 가족법의 토대가 되는 것이자연스럽다.
다음으로는, 남북한 혼인법 간에 차이가 있는 규정들인데, 혼인연령, 근친혼금지, 혼인의 무효와 취소, 부부재산계약, 재판상 이혼사유, 부부의 가정재산의 분할 등이다. 이에 대해서는 기득권존중과 법적 안정성을 위해서 일정한 경과규정을 두어야 한다.
마지막으로, 북한 가족법의 규정과 재판실무에 있어서 정치성을 띠는 규정들이 있는데, 실질적 혼인연령에 대한 것, 혼인과 이혼과정에 있어서 정치적의도로 관여하는 것, 인민군에 대한 이혼의 소에 대한 재판소의 기각판정 등이다. 이러한 규정들은 자유민주적 기본질서에 배치되는 것이라는 점에서 통일 이후 폐기되어야 한다.
이 밖에 북한 가족법 중에서 부모가 이혼하는 경우에 3살 미만의 자녀에대해서 어머니가 양육권자가 되도록 하는 규정, 양육비의 규모를 정하는 규정등은 혼인법의 통합에 있어서 긍정적으로 수용할 만한 요소이다.

영어초록

This paper examines the marriage and divorce-related regulations in the NorthKorean Family Law, and based on this, compares the marriage laws of South andNorth Korea to each other and puts forward its integration measures.
First of all, there are no difficulties in integration because there are no relatedregulations in the North Korean Marriage Act yet or similar regulations to our civillaw, in other words, it is natural that the provisions of our marriage law are thebasis of the Unification Family Act, as it concerns the matrimonial engagement, theduties of husband and wife, the divorce by agreement, the procedure of judicialdivorce, the decision on the custodian, the visitation rights, and the claim for divisionof property.
In addition, among the differences in the marriage law between the two Koreas,certain transitional provisions should be placed for the respect of vested interests andlegal stability on the marriageable age, the prohibition of consanguineous marriage,the nullity and annulment of marriage, the Agreement on Matrimonial Property, theCauses for Judicial Divorce, and the division of the couple’s family property.
Finally, there are the provisions of the North Korean family law and politicalrules in the judging practice. In other words, the actual marriage age, politicalinvolvement in the marriage and divorce process, and compelling the court to dismissthe divorce lawsuit against the People’s Army are contrary to the liberal democraticbasic order. Therefore, these regulations should be discarded after unification.
In addition to this, among the provisions of the North Korean Family Law, theequality of the sexes, the rule that a mother is the custodian of a child under 3years of age in case of a parent divorce, and the regulation on the size of child support deserve positive acceptance to the integrated marriage law.
