법의 근거 이론과 법률해석―헌법합치적 해석과 헌법정향적 해석의 법이론적 함의― (Theories of Grounds of Law and Methods of Statutory Interpretation: Legal-theoretical Implications of the Method of Constitution-oriented Statutory Interpretation)

초록

최근 우리 대법원의 판결에서 ‘헌법합치적 해석’과 ‘헌법정향적 해석’이라는법률해석 방법이 제시되었다. 이 논문의 목표는 헌법합치적 법률해석과 헌법정향적 법률해석 방법의 법이론적 함의를 해명하는 데 있다. 법률해석이 ‘있어야 할 당위의 법’이 아니라 ‘있는 법’에 따라 해석하여 사안에 적용할 법규범을산출하는 활동이라면, 법률해석의 목표는 지금의 이 사안에 적용할 ‘있는 법’의내용이 무엇인지를 인식하고 확인하는 데 있다. 따라서 법률해석의 문제는 ‘있는 법’의 내용은 무엇 덕분에, 무엇 때문에 존재하게 되고 무엇에 의해 정해지는지의 법이론적 문제에 관한 해답에 의존한다.
이 논문에서 주장하는 내용은 다음과 같다. 첫째, ‘있는 법’을 존재케 하고 그 내용을 결정해 주는 법의 근거 문제, 즉 법의 결정인자의 문제와 법률해석의 문제는 긴밀하게 연결된다. 사회적 사실들과 도덕·정의 원리들이 법의 근거로서 함께 작용한다는 자연법론·비실증주의의 입장에서 헌법합치적 법률해석과 헌법정향적 법률해석을 이해할 때 그 취지가 가장 잘 구현된다. 둘째, 특정한도덕·정의 원리들이 지시하는 대로 그리고 이 도덕·정의 원리들 덕분에 법실증주의적 법 근거인 사회적 사실들이 ‘있는 법’을 구성하고 성립·존재케 하며그 내용을 결정할 수 있게 된다는 ‘도덕 구조화 기능 버전’의 자연법론·비실증주의가 도덕 필터 버전의 자연법론·비실증주의보다 더 낫게 헌법합치적 법률해석과 헌법정향적 법률해석의 방법을 구현할 수 있다. 셋째, 법실증주의적 법의 근거인 사회적 사실들을 법의 근거로 만드는 도덕에 국가와 법과 사법부의역할에 관한 정치도덕이 포함된다는 점에서 정치철학은 법의 근거 이론을 통해법률해석으로 들어오게 된다.

영어초록

What stands out in our supreme court’s recent decisions is the application and development of the method of ‘constitution-conforming’ and ‘constitution-oriented statutory interpretation’. In particular, the method of constitution-oriented statutory interpretation plays an important role in our supreme court’s decisions. The purpose of this article is to clarify the legal-theoretical implications of constitution-oriented statutory interpretation. If legal interpretation is an activity that interprets according to ‘the law that exists’ rather than ‘the law that ought to exist’ and derives the content of ‘law as it is’ to be applied to the case at hand, legal interpretation should identify and confirm the content of the ‘law as it is’.
Therefore, the question of legal interpretation is intimately related to that of the grounds of law. This central legal-theoretical problem consists in the clarification of what are the determinants of law, or what is the basis of the law that constitutes the ‘law as it is’ and determines its contents.
While positivist theories of the ground of law assert that (exclusively or primarily) social facts alone constitute ‘law as it is’ and determine its contents, non-positivist theories to be developed in this article insist that social facts and moral facts work together as the grounds of law. Depending on the priority relation between social facts and moral facts in constituting and determining ‘the law as it is’, nonpositivism is divided into moral filtering versions and moral architecting/structuring (or moral reading) versions. This article argues that the latter are better than the former in explaining and justifying the grounds of law, and that the methods of constitution- conforming and constitution-oriented statutory interpretation can be best understood in light of a moral architecturing/structuring (or moral reading) version of nonpositivism.
